    Senior Legal Counsel

    Key Customers

    MCG business divisions with a particular focus on the General Entertainment division, and External service providers

    Purpose of the Position:

    • To provide expertise and advice on legal aspects of the General Entertainment strategy.
    • To facilitate business transactions with a specialised focus on content rights acquisition and intellectual property.
    • To provide expertise and advice on legal aspects of corporate decisions, policies and plans.
    • Assist with legal and regulatory compliance; dispute resolutions, settlement negotiations and discussions.

     

    Key Performance Objectives Tasks

    Strategy Execution

    • Provide input in the formulation and implementation of the General Entertainment Legal Strategy
    • Implement MultiChoice’s Intellectual Property Strategy

     

    Legal Support

    • Provide advice on corporate and commercial transactions, with a specialist focus on rights related transactions and content acquisitions of General Entertainment television programming content.
    • Negotiate, draft and review various agreements, specializing in general entertainment and content rights acquisition agreements with both local and international content producers (i.e. production agreements, co-production agreements, licensing agreements, sponsorship agreements, content sales agreements, commercial agreements, IT agreements, IP agreements).
    • Provide legal guidance on the complex set of rights acquired under the content agreements.
    • Advise on IP related queries.
    • Prepare presentations on various legal topics.
    • Manage litigation matters.
    • Liaise and help manage external parties (including local and international suppliers and external attorneys).
    • Conduct training on pieces of legislation applicable to MCG.
    • Conduct legal research


    Governance

    • Provide advice on corporate governance developments and ensure adherence thereof.
    • Advise on, and ensure adherence to, legislation applicable to MCG, with a focus on content production, licensing and content distribution.
    • Assist with the Implementation and management of the Legal Compliance Programme (including preparation of Risk Registers for the board).




    Qualifications: Essential

    • A graduate degree in Law/LLB
    • Admitted attorney in South Africa
       

    Qualifications: Preferred

    • LLM in Media Law

     

    Experience

    • A minimum of 8 - 10 years’ commercial legal experience
    • At least four years post articles experience
    • At least 3 years in a media environment, preferably in content acquisitions
    • Experience in the broadcasting industry will be advantageous
