    Legal Advisor - Regulatory and Compliance - Centurion

    Key Responsibilities
    The Legal Advisor - Regulatory and Compliance will be resposble for: 

    1. Regulatory analysis and compliance monitoring

     

    • Conduct comprehensive analysis of relevant energy regulations, policies, and legislation to identify potential legal implications and provide accurate advice to stakeholders.
    • Stay updated on all existing and emerging regulatory requirements, laws, and policies relevant to the energy procurement industry in South Africa.
    • Collaborate with internal teams to develop and implement effective compliance programs and policies
    • Anticipate and recommend adaptations to regulatory changes in energy procurement landscape

    2. Legal Advisory

     

    • Advise on legal issues related to energy procurement processes, including applicable legislation, compliance requirements, and risk mitigation.
    • Liaise with regulatory authorities, legal representatives, and external stakeholders to address regulatory and compliance-related matters in regard to procurement of new generation capacity and advise of the appropriate way forward.
    • Undertake legislative drafting or review proposed legislative amendments which impact and intersect with the IPP Office
    • Assist in the resolution of any disputes, litigation, or other legal matters related to energy procurement operations
    • Provide assistance and guidance when developing procurement frameworks to ensure regulatory compliance
    • Provide advice and guidance on regulatory compliance by the IPP Office in respect of its operations and the procurement programmes

    3. Document drafting and contract management

     

    • Analyse and interpret complex legal documents, statutes, regulations, and contractual arrangements, and provide guidance and advice to internal stakeholders.
    • Provide legal guidance and support in the development, drafting, and review of procurement documents, procurement contracts, agreements, and other legal documents.Draft relevant regulatory provisions and clauses for procurement and other legal documents such as RFPs, Power Purchase Agreements, Implementation Agreements, etc.

    4. Risk assessment and mitigation

     

    • Identify and mitigate regulatory and compliance risks in the energy procurement framework, processes and documentation.
    • Recommend risk management and mitigation strategies to ensure compliance and reducing the likelihood of regulatory breaches.
    • Monitor industry trends and changes in regulations to ensure ongoing compliance and proactively identify risks or opportunities for the IPP Office.

    5. Effective self-management and team work

     

    • Apply knowledge and organisation systems, structures , policies and procedures to achieve results
    • Demonstrate initiative in follow through to ensure that personal quality and productivity standards are consistently and accurately maintained
    • Provide appropriate resolution for tasks or deadlines not met
    • Act in a manner that is in line with and consistent with the professional integrity and ethics applicable to Attorneys
    • Maintain a positive attitude and respond openly to feedback
    • Take ownership to drive own career development

    Requirements:

     

    • Bachelor's degree in Law or equivalent (LLB or equivalent)
    • Admitted as an attorney or advocate in South Africa
    • Minimum 5 years of experience in regulatory and compliance legal advisory roles, preferably in the energy sector or related field
    • Strong knowledge of South African energy laws and regulations, including the Electricity Regulation Act, National Energy Regulator Act, and related legislation
    • Proven ability to manage multiple projects and prioritize tasks effectively
