Job Description

• My client (oil and gas) is currently looking for a Legal Manager to join their team in Durban.
• You will be responsible for offering advice on all business legal issues and completing tender documents as well as dealing with insurance and claim related matters.
• To be considered for this role the candidate MUST have experience liaising with insurance brokers, strong commercial legal understanding and knowledge of petrochemical storage legislation.

Duties include:
Legal

• Review all property agreements
• Draft, review, edit, interpret, and approve all new service provider contracts or amendments to existing contracts
• Oversee all onerous contractual obligations
• Ensuring compliance to construction laws and regulations
• Advising on the latest building standards
• Review and authorize all standard customer agreements
• Draft and/or review non-standard customer and tenders when required
• Provide legal support as and when required by the business
• Assist in negotiations with customers and tenders when required 

Litigations

• Deal with any letters of demand or summons served
• Manage external Attorneys
• Depose to necessary affidavits

Risk management

• Provide legal input to the Risk Committee and attend meetings
• Attend Freight Risk and ESG committee meetings when required
• Investigate relevant ethics hotline cases and send reports 

Stakeholder management

• Assist with all legal requirements of stakeholders
• Review legislation and regulation and ensure compliance thereof
• Review the National Ports Act and ensure compliance thereof
• Provide legal support to external customs matters when required 

Audits

• Prepare a biannual legal audit plan that addresses all areas of compliance
• Assist in developing the necessary legal compliance audit questionnaire on Isometrix
• Arrange independent legal compliance audits (including, SHE, SARS etc.)
• Prepare and issue internal legal audit reports and ensure findings are closeout

Insurance

• Deal with general insurance queries
• Liaise with insurance brokers where necessary
• Collate necessary information for annual insurance declarations
• Ensure familiarity with the contents of policy and communicate to the business 

Claims

• Manage claims process from logging to completion.
• Report claims to insurers
• Assist with communication to third parties and/or customers where necessary
• Liaise with assessors, including attendance at surveys if necessary
• Liaise with General/Terminal managers regarding claims and incident investigations
• Review incidents investigation reports when required

Required Skills

• Bachelor of laws (LLB) Degree.
• Minimum 5 years legal experience in dealing with legal professionals and insurance brokers.
• Strong commercial legal understanding and insurance knowledge
• Knowledge of Petrochemical storage legislation would be advantageous
• Strong organizational skills that reflect an ability to perform and prioritize multiple tasks in an energetic and changing environment with multiple priorities
• Excellent judgment and ability to anticipate legal issues or risks.
• Good auditing skills
