    Analyst Financial Advisers and Intermediaries Department (Pretoria)

    Purpose of the Job:

    • To assist the department in ensuring that the approved authorised Financial Services Providers (FSPs) and their Compliance Officers complies with the Financial Advisory and Intermediary Services (FAIS) legislation. The person appointed to this position will report to the Manager.

    Key Performance Areas:

    • Monitor compliance with legislation to ensure sound and efficient Financial Services Providers and the protection of consumers;
    • Analyse annual financial statements of Financial Services Providers to ensure that proper reporting standards and procedures have been followed;
    • Analyse compliance reports of Financial Services Providers;
    • Identify and report trends in the financial services sector with possible impact on the FSCA’s regulatory objectives;
    • Identify financial risks based on analysis of financial statements and any other financial information;
    • Perform on site visits in terms of risk based supervision approach;
    • Liaison with Financial Services Providers; and
    • Perform administrative or other activities relating to the regulation framework.

    Other Key Competencies:

    Requirements

Good knowledge and/or experience of the FAIS regulatory framework and understanding of the insurance or banking industry is essential. Knowledge of Crypto Assets Services Providers (CASPs) will be considered an advantage.

    Senior Analyst Investment Providers (Pretoria)

    Purpose of the Job:

    • To assist the department in ensuring that the approved authorised Financial Services Providers (FSPs) and their Compliance Officers comply with the Financial Advisory and Intermediary Services (FAIS) legislation and its subordinate legislation. The person appointed to this position will report to the Manager.

    Key Performance Areas:

    • Take part in the implementation of a Conduct Risk Framework as part of supervision and monitoring;
    • Perform onsite inspection in terms of risk-based supervision approach;

    • Perform administrative or other activities relating to the regulation framework.

    Investigator x5 Enforcement Department (Pretoria)

    Purpose of the Job: 

    • To conduct forensic regulatory investigations within the financial services industry (financial markets, insurance, collective investment schemes, hedge funds, pension funds and financial and advisory services) and to take responsibility for the regulatory and enforcement action, following from such investigations. Persons appointed to these positions will report to the Senior Manager. 

    Key Performance Areas:

    • Assess complaints and new cases for further action.
    • Create and execute clear, focused, and efficient investigation plans with reasonable timelines.
    • Conduct quality investigations (gathering all relevant, admissible evidence and proper analysis of the evidence);
    • Take responsibility for the execution of all enforcement actions, including the drafting of all enforcement documentation presentation to enforcement meetings, debarments, withdrawal of licences and administrative penalties. 

    Other Key Competencies:

    • Candidates must demonstrate the following skills and attributes: proven interviewing skills, a confident and decisive approach particularly in difficult situations must be a person with a high level of judgement and integrity; and must be able to carry out duties independently, impartially, and objectively. Candidates must be able to draft investigation reports, with findings properly supported by cross-referenced evidence.  

    Requirements

    • An LLB, Accounting, or Forensic orientated degree, with at least 3 to 4 years’ experience in litigation, prosecution, forensic investigation, or forensic accounting; an admitted attorney or advocate (for law incumbents) A good knowledge and understanding of the law of evidence (admissibility; documentary and computer-generated evidence); and the financial sector will be an advantage.

    Regulatory Advisor Regulatory Framework (Pretoria)

    Purpose of the Job: 

    • The Regulatory Advisor will be responsible for assisting the Senior Manager and Head of Department with the on-going review and development of regulatory frameworks and where applicable, engaging with National Treasury regarding the development of primary legislation in respect of which the FSCA has jurisdiction. The person will also be responsible for providing regulatory support to other Divisions within the FSCA. The person appointed to this position will report to the Senior Manager: Regulatory Framework Department.

    Key Performance Areas:

    • Assist the Senior Manager and Head of Department with the on-going review and development of regulatory frameworks;
    • Assist in developing, implementing and maintaining operational processes and procedures to improve the functioning of the Regulatory Framework Department 
    • Assist in designing, managing, coordinating and executing projects in the Regulatory Framework Department and broader FSCA;
    • Conduct relevant research (including comparative research) to improve the standard of regulation in line with national and international developments and requirements;
    • Author or contribute to research papers, discussion documents, issue papers, policy position papers and proposals to evolve and develop primary or secondary legislation
    • Author or contribute to guidance notices, interpretational rulings, application forms, information requests, communications and other documents assisting with the implementation of the legislative framework;
    • Assist in facilitating and coordinating meaningful input to comments on documentation and legislation published for consultation;
    • Assist in managing and promoting relationship with local, regional and international regulators, industry bodies, government departments and any other internal and external stakeholders;
    • Participate in local and foreign initiatives, committees, conferences, meetings, and other engagements falling within the purview of the Regulatory Framework Department;
    • Provide regulatory support to other FSCA Divisions/Departments;
    • Handle and respond to external queries regarding the interpretation and application of regulatory and legislative provisions; 
    • Internal and external stakeholder engagement on regulatory developments; and
    • Assist in preparing and compiling management or other reports.

A broad knowledge of the industries regulated by the FSCA is necessary. Experience in the retirement fund; investments; and financial markets environments, as well as coordinating, participating in, and researching international and local matters will be a further added advantage.

    FSCA Bursary For Students With Disabilities (Pretoria)

    Description:

    • The FSCA offers bursaries to matriculants and/or students with disabilities who are studying at any recognised South African university or any accredited institution of higher learning.

    What the Bursary Covers:

    • The FSCA bursary for students with disabilities covers full-time studies in Data Science / Business Management / BCom: Economics / BCom: Finance and Bachelor of Laws degree. This bursary covers registration costs and tuition fees, prescribed textbooks, accommodation including meals, monthly allowance for incidental expenses and supportive learning device such as a wheelchair, Zoom Text software, or a Jaws Reader, computer or any device recommended by a medical doctor.

    Duration:

    • The bursary will be awarded for the duration of the identified qualification.

    What is Expected

    • The bursar(s) will be required to enter into a work-back contract with the FSCA proportional to the number of years they have been funded by the organisation. Experiential learning will be provided to bursar(s) during and upon completion of their studies.

    Requirements

    • The bursary is for undergraduate studies in disciplines identified above. Applicants must be in possession of a South African barcoded identity document / ID card.     Departmental Head Project Management Office (Pretoria)

    Purpose of the Job:

    • Responsible for leading, developing, monitoring and managing the PMO function. The role will support the successful delivery of organizational strategic programs undertaken by providing oversight to inform prioritization decisions, defining and maintaining project management standards through effective facilitation, tracking and reporting. The candidate must demonstrate experience in leading diverse teams, experience with Agile methodologies and one or more project management methodologies (e.g. PMI PMBOK, and PRINCE2).Demonstrated management/supervisory experience in project management and the execution of multiple or large projects, during which more than one of the following occurred – Thought leader with a view to creating a viable PMO service and supporting pragmatic delivery of projects; Competency in strategic thinking and leadership, with strong abilities in relationship management; Leadership of multidiscipline and high-performance work teams; Proven track record of successful delivery of programs and projects; and Good knowledge of portfolio management strategy.

    Specialist Analyst Market Research And Economic Analysis Department(Pretoria)

    Purpose of the Job:

    • To design and apply research techniques to gather, process and analyse insights. Gather insights through conducting relevant market and bespoke research.     • Perform such other tasks necessary or desirable to enhance the performance of the department.
