    Compliance Assistant

    Role Description
    Duties and Responsibilities:

    • Conduct and oversee FICA/KYC checks: Perform and meticulously review FICA (Financial Intelligence Centre Act) documents, such as KYC (Know Your Customer) and Customer Due Diligence (CDD) for all transactions handled by the buying, sales, and finance departments.
    • Ensure compliance and accuracy: Proactively identify, investigate, and escalate any discrepancies, or non-compliance issues to management and relevant stakeholders.
    • Provide expert guidance: Serve as a primary point of contact for internal teams, offering clear guidance and support on FICA documentation requirements and best practices.

    Legal Manager

    Role Description

    • We are seeking a suitably qualified Legal Manager to join the We Buy Cars Legal & Compliance team. The successful candidate will be responsible for providing legal advice across various business functions while managing complex, multifunctional matters. Reporting directly to the Head of Legal, the Legal Manager will provide essential support to both the legal leadership and the broader compliance function.

    Duties and Responsibilities include: 

    Legal Advice and Risk Mitigation:

    • Advise on all legal matters with a particular focus on contracts, litigation, ombud matters and regulatory compliance.
    • Research and provide legal opinion on a variety of issues and business projects within the business to proactively identify, assess and mitigate legal and reputational risk.

    Contracts:

    • Draft, vet and negotiate a wide variety of commercial contracts.
    • Create, manage and update the contract template database.
    • Contract management: oversee the lifecycle of key operational contracts and certificates/licences (including renewals, cancellations and terminations).

    Dispute Resolution and Litigation:

    • Oversee complaints lodged with the relevant industry ombudsman and consumer tribunals.
    • Litigation portfolio management, including managing the instruction of external attorneys, reviewing pleadings, and taking the lead in drafting and finalising settlement agreements.
    • Preparation of affidavits and liaising with the South African Police Services on the impoundment of motor vehicles.

    Regulatory Compliance

    • Keep abreast of all relevant legislation relating to the automotive and related industry, best practices and provision of proactive advice, training and solutions to staff and relevant stakeholders.
    • Support the FIC compliance team where required.
    • Manage and oversee POPIA compliance.
    • Policy formulation, implementation and monitoring.

    Other:

    • Support the Legal and Compliance team as required.
    • Manage and give legal advice on the protection of the company’s trademarks and IP infringements
    • Support the Head of Legal with board reporting and the preparation of other reports and presentations.

    Role Requirements

    • LLB / Law Qualification from a recognised university
    • Admitted Attorney of the High Court of South Africa
    • 5 years post-admission experience
    • At least 1 -2 years of in-house legal experience

    • Perform service, repair, and maintenance on customer vehicles in accordance with manufacturer and company standards. 
    • Conduct mechanical and electronic diagnostics using advanced diagnostic equipment and tools. 
    • Accurately diagnose and fault-find across a wide range of vehicle types, including engines, electrical systems, and electronic control units (ECUs).
