    Commercial Practitioner

    Job Description

    To provide a cost effective procurement function focusing on commercial and legal terms and conditions of procurement contracts, the creation of value, management of commercial risk inherent to the procurement process, and implementing and maintaining international best practices, policies and procedures.
    Furthermore to ensure that the Contractor’s performance meets contractual requirements by pro-actively maintaining and managing contractual terms, deliverables and financial administration of contracts for the Venetia Underground Project.
    This position includes the provision of a comprehensive and professional administrative function. This position reports to the Supply Chain Manager, with a strong interface with Technical Managers for the various contracts as well as all other VUP departments in terms of Procurement. This position requires the incumbent to be mobile to travel to Venetia Mine.

    Key Result Areas:

    • Compile meaningful, commercially apt and legally correct enquiries to selected Tenderers, manage the entire tender process, provide meaningful commercial and legal tender analyses as well as negotiate with suppliers/contractors/consultants. Present findings during approval process.
    • Produce contract documents (standard or specialized) based on the enquiry, incorporating decisions made at negotiations and pre-award meetings with the successful Tenderer in the best interest of the Company, with minimal risk exposure to the Company.
    • Identify areas of contractual agreement to maximise opportunity for the company at minimal risk.
    • Maintain all Procurement Registers.
    • Co-ordinate, compile documentation and attend Tender Board Meetings.
    • Ensure compliance with relevant DBCM and VUP policies and procedures, maintaining an excellent governance track record.
    • Pro-actively manage POP requirements and keep current at all times.
    • Coordinate the Purchase Requisition process, creating and maintaining requisitions on SAP.
    • Initiate supplier and product research.
    • Contribute to Social Labour Plan targets in terms of local, HDSA and ED/SD initiatives and spend.
    • Coordinate and collate information for the drawing up of required Supply Chain and Cost reports
    • Manage and co-ordinate the compilation of the BoQ for enquiries/ contracts/ amendments/ orders/compensation events.
    • Conceive, develop and deliver techniques, practices and procedures for contract formation and administration in a manner that best protects the Company’s interests.
    • Scheduling, attendance and outcome management of all contractual, Compensation Event and progress meetings.
    • Administer contracts by producing and assessing amendments, compensation events, contractual correspondence and early warnings as required and applicable, as well as ensuring contractual compliance in all aspects.
    • Evaluate and submit requests as well as obtain approvals for variations and amendments to contracts.
    • Responsible for contract change management.
    • Pre-authorisation of payments consistent with the contract terms.
    • The logging of all Contract Manager Instructions, Early Warnings and Compensation Events/Site Variation Requests in a Register per contract, kept current at all times.
    • Manage and co-ordinate monthly payment certificates and Cost/Contract Reports for the Contract Manager. Ensure timeous resolution to all cost-related issues.
    • Manage, co-ordinate and report on all contractual deliverables.
    • Claims and dispute resolution resolved in a timely manner.
    • Evaluate, implement and co-ordinate the closure of contracts.
    • Maintain appropriate records and filing.
    • Manage all documentation relating to Procurement and Contract Administration, ensuring compliance with the procedures established by the Company.
    • Be focused on relationship contracting and have experience in this arena. Build relationships with project team, suppliers, service providers and contractors.
    • Monitor Contractor progress and performance to ensure the deliverables conform to the contract requirements.
    • Evaluate and record supplier performance (with project team) and manage issues of non-compliance to contract conditions and require deliverables.
    • Identify opportunities for AAC SC / DBGS / Venetia Mine / VUP integration to the benefit of the Project.
    • Identify opportunities for, initiate and develop strategic, long term and specialised agreements that will have a significant impact on reducing the Project’s total cost of ownership.
       

    Qualifications

    • Experience in working with NEC and an in depth understanding thereof will be essential.
    • Experience in and in-depth knowledge of the project commercial environment will be essential.
    • 3-5 years applied procurement experience within the procurement/contracts environment with emphasis on contractual risk and adding value.
    • Capital Project experience of 5 years on projects with values of greater than R100 million will be advantageous
    • Advanced understanding and implementation of commercial law principles.
    • SAP experience and integral knowledge thereof will be advantageous.
    • Degree/national diploma.
