Summary
Purpose:
To implement an effective Business Unit Employee Relation and Compliance strategy, philosophy, policy and principles to ensure effective Employee Relation practices and legislative adherence aligned with Group strategy.
Minimum Requirements
QUALIFICATIONS:
- BCom Human Resources Management (Essential/Minimum)
- Certificate Industrial Relations (Essential/Minimum)
- Certificate First Line Management (Essential/Minimum)
EXPERIENCE:
- 5 years Experience in Human Resources and Employee Relations fields/areas. Relevant experience in employee relations with a negotiations background with exposure to the labour law environment. (Essential/Minimum) Operational

Duties & Responsibilities
- Budget and Cost Control Manage and control the allocation of funds to ensure adherence to approved budgeted expenditure
- Assist in compiling the budget by providing information based on operational and resource requirements basis
- Business Performance and Operations
Implement and institutionalise the Company’s Employee Relationship (ER) strategy, philosophy, policy and principles to ensure equitable and rewarding recognition practices aligned with Company strategy
- Advise Line Management and Human Resources (HR) on policies procedures legislation and agreements in respect of ER and Compliance
- Develop and execute ER objectives and plan to ensure an effective ER climate supporting the business plan and achievement of business goals and objectives
- Collect information regarding the ER climate, rumours tendencies union rivalry leadership rivalry etc. evaluate the information and make recommendation
- Develop strategies that will address tendencies/problem areas and give advice on preventative measures to line management and HR
- Provide professional independent advice to line and HR regarding the application of the disciplinary procedure and appeals (individual and group disciplinary matters)
Compliance, Governance and Assurance
- Assess audit and ensure compliance with all statutory requirements by conducting market analysis networking and benchmarking
- Advise on the development of Labour relations policy and principles as well as integration of related guidelines and procedures
- Ensure BU complies with corporate governance, statutory, legal and other requirements (Social and Labour Plan (SLP), Employment Equity (EE), Mining Charter, Workforce Skills Plan (WSP) and Annual Training Report (ATR))
- Ensure the achievement of Employment Equity targets within the designated areas
- Ensure HR practices and policies comply with legislative requirements such as but not limited to the Labour Relations Act (LRA), Basic Conditions of Employment Act (BCEA), Employment Equity Act (EEA), Compensation for Occupational Injuries and Diseases Act (COID), Unemployment Insurance Fund (UIF), Skills Development Act (SDA), Mine Health and Safety Act (MHSA), Broad Based Black Employment Equity (BBBEE) and Mining Charter
Monitor contractors regarding HR related matters to be complied within terms of legislation, agreements etc. deviations to be reported to Supply Chain for corrective actions
Customer and Client Relationship Management
- Maintain relationships with both internal and external customers to promote department and overall company image
- Ensure that customers within the Business Unit (BU) are satisfied with the delivery of employee relations services
- Maintain a positive relationship with the trade union and related representatives
- Attend to customer requests and complaints conduct regular follow-ups to ensure problems have been resolved
Effective People Management
- Lead and develop HR Business Partners on matters pertaining to ER processes and policies
- Provide inputs for efficient development, career path and deployment of staff
- Take action to correct subordinates' performance deviations (if applicable)
Functional Excellence
- Develop and maintain functional policies, standards, guidelines, procedures, end-to-end processes, tools, templates etc. and enforce group-wide adherence to these
- Standardise, simplify and speed-up functional processes and eliminate duplication/bureaucracy
- Develop and apply functional best practices and promote sharing of best practices/knowledge
- Identify and manage critical functional risks through appropriate mitigation plans and actions
Learning and Growth
- Promote teamwork provide support and manage performance on a regular basis
- Ensure that own Individual Development Plan (IDP) and subordinates are active and trackable
- Apply leading edge ER practices to optimize the business benefit of all stakeholders
- Identify best practices across the system and ensure that successful programs are shared across the company
- Participates and contributes in relevant industry forums and network groups

Specialised Support
Advise line and HR regarding the application of the grievance procedure (individual and group grievances)
- Audit and evaluate all disciplinary and grievance cases for correctness and advice on identified mistakes to prevent reoccurrence
- Execute and assume responsibility for representing the company in conciliation and arbitration proceedings
- Advise on issues that are strike able (develop company strike management procedure)
- Investigate and follow-up on ill health cases monitor progress and advice on solutions
- Execute and assume responsibility for collective bargaining, regarding BU related issues
- Develop consultation strategy for collective and individual consultations for the BU
Administers Employment Equity
- Verify trade union memberships and monitor activities
- Conduct and facilitate negotiations with the Trade Unions
- Develop and provide ER related training to line HR shop stewards and employees (legislation agreements etc.)
