    Specialist Analyst - Markets, Issuers and Intermediaries Department

    Purpose of the Job

    • The Markets, Issuers and Intermediaries Department of the FSCA is responsible for licensing and supervising market infrastructures  (i.e exchanges) operating within the South African financial markets in terms of the Financial Markets Act, 2012 (Act no 19 of 2012). 
    • The department has oversight responsibilities over public markets, authorised users and issuers. The person appointed to this position  will be stationed in the Market Integrity and Decision Sciences Division and will report to the Manager.

    Key Performance Areas

    •  Assist in identifying shortcomings and anomalies to the regulatory framework;
    •  Assist in proposing changes to the regulatory framework and assist the Department with the implementation of such changes;
    •  Assist to develop and maintain an effective and efficient supervisory framework within the context of the approved legislation;
    •  Assist with the monitoring of compliance with the provisions of the Financial Markets Act and subordinate legislation;
    •  Assist to plan and conduct inspections;
    •  Liaise with and render appropriate regulatory guidance to stakeholders after consultation with the Manager and Head of Department.
    •  Assist in conducting investigations regarding Market Infrastructures and to ensure that all relevant complaints are dealt with; and
    •  Apply risk assessments and risk management techniques.

    Specialist Analyst - OTC Markets, Issuers And Counterparties Department

    Purpose of the Job

    • To advise the Market Infrastructures and OTC Derivatives Providers internally on a wide range of practices, conduct and concerns affecting the industry and allied activities. The person appointed to this position will have a direct reporting line to the Senior Manager:  OTC Market Supervision. 

    Requirements

    • A business, economics, accounting, mathematics degree or similar, with at least 5 years relevant experience, preferably in regulation, finance, risk management, audit or management consulting role within the South African Capital Markets Industry, finance or related commerce. Experience within a financial markets environment, investment banking, structured finance or similar will be a distinct advantage. An ability to understand complex financial instruments and processes including derivatives, bonds, equities and foreign exchange and the risks associated with these instruments would be desirable. 

    Key Performance Areas

    •  Identify shortcomings and anomalies to regulatory framework and subordinate legislation;
    •  Assist the Department with the analysis and assessment of conduct of market on financial markets legislation;   
    •  Assist with the reform of financial markets legislation to reflect operating realities as the need arises; 
    •  Consider and advise the Department on proposed amendments to the listing requirements and rules of the market infrastructures; 
    •  Assist the Department to maintain an effective framework for supervision of Market Infrastructures and Over-the-Counter Derivatives Providers (ODPs);
    •  Assist in the supervision and the monitoring of compliance with financial markets legislation, regulations and the rules of the market infrastructures;
    •  Represent the Authority at relevant meetings of the Market Infrastructures; 
    •  Liaise with and render appropriate regulatory guidance to stakeholders after consultation with the Senior Manager and Head of Department.

    Senior Analyst - Retirement Funds: Conduct Supervision Department

    Purpose of the Job: 

    • To regulate and supervise retirement funds through monitoring compliance with the Pension Funds Act, Regulations, Conditions and Financial Sector Conduct Authority’s (FSCA) policy to safeguard the interest of both the members of the funds through the analysis of S14 applications, withdrawals, amendments, extension applications and exemptions related thereto. The person appointed to the position will report to the Manager

    Key Performance Areas:

    •  Evaluate, analyse and review applications for the transfer of business between retirement funds;
    •  Ensuring that legislation and the rules of funds are complied with when granting section 14 approval; 
    •  Review and analyse applications for the withdrawal or amendment of approved section 14 applications and make recommendations to the Manager;
    •  Assisting with the regulation of retirement funds in as far as section 14 transfers are concerned;
    •  Deal with the administration and analysis of applications for extensions;
    •  Identifying systemic risk to the industry and make necessary recommendations;
    •  Assist with enquiries from administrators, funds and members (treat customers fairly);
    •  Assisting the Manager and HOD with statistical / management reports;
    •  Undertaking projects at the request of the Manager or the Departmental Head.

    Other Key Competencies:

    • The candidates must demonstrate the following skills and attributes: An excellent command of both spoken and written English and proficiency in the use of Microsoft Office and computerised workflow systems, report writing, numeric, verbal and analytical skills; The candidate must be able to plan independently and be deadline driven, ability to work effectively, independently and in a team be able and to learn from and transfer knowledge and skills to colleagues. A commitment to improving outcomes for members of retirement funds and their dependants and the energy, initiative, emotional intelligence and inter-personal skills required.

    Analyst X 2 - Financial Advisors And Intermediaries

    Purpose of the Job: 

    • To assist the department in ensuring that the approved authorised Financial Services Providers (FSPs) and their Compliance Officers complies with the Financial Advisory and Intermediary Services (FAIS) legislation. The person appointed to this position will report to the Manager. 

    Key Performance Areas:

    •  Monitor compliance with legislation to ensure sound and efficient Financial Services Providers and theprotection  of consumers;
    •  Analyse annual financial statements of Financial Services Providers to ensure that proper reporting standardsand  procedures have been followed;
    •  Analyse compliance reports of Financial Services Providers;
    •  Identify and report trends in the financial services sector with possible impact on the FSCA’s regulatoryobjectives;
    •  Identify financial risks based on analysis of financial statements and any other financial information;
    •  Perform on site visits in terms of risk based supervision approach;
    •  Liaison with Financial Services Providers; and
    •  Perform administrative or other activities relating to the regulation framework.

    Specialist Analyst - AML/CFT Supervision Department

    Purpose of the Job: 

    • To supervise and/or enforce compliance with the Financial Intelligence Centre Act, by the Financial Institutions categorized as accountable  institutions and ensure that any referrals relating to AML/CFT matters received from the Financial Intelligence Centre are appropriately dealt  with within the FSCA. The person appointed to this position will report to the Manager: AML/CFT Supervision Department.

    Key Performance Areas:

    •   Monitor and enforce compliance with the FIC Act by the financial institutions;
    •   Identify and report trends in the financial services sector with possible impact on the FSCA’s ability to discharge its duties as a Supervisory Body;
    •   Conduct on-site and/or offsite inspections and other supervisory activities in terms of the FIC Act;
    •   Investigate all complaints relating to financial institutions;
    •   Refine processes and procedures relating to regulatory and supervisory frameworks;
    •   Actively participate in and contribute to industry and FSCA committees as and when required;
    •   Assist junior staff with planning and performance on supervisory activities;
    •   Assist the Manager in training and development of Junior Staff; 
    •   Liaise with internal and external stakeholders in respect of regulatory and supervisory matters; and
    •   Perform administrative or other supervisory activities relating to the regulatory framework.
