    Departmental Head Regulatory Framework (Hybrid) (Pretoria)

    Purpose of the Job:

    • The Departmental Head: Regulatory Frameworks is a leadership and management role that is responsible for overseeing the strategy and operations of the FSCA’s Regulatory Framework Department, including: overseeing the maintenance and development of regulatory frameworks falling within the FSCA’s jurisdiction; engaging with National Treasury regarding the development of primary legislation relevant to the FSCA; contributing to and/or driving policy initiatives;, promoting and managing relationships across a broad scope of internal and external stakeholders; and providing regulatory support. The person appointed to this position will report to the Divisional Executive: Regulatory Policy. 

    Key Performance Areas:

    • Strategic leadership for the Department and advising the Divisional Executive: Regulatory Policy on matters within the Department’s scope of responsibility and expertise.
    • Maintain the highest standards of good governance and financial management; and manage reporting and administrative obligations relevant to the Department, in line with corporate governance best practice and the FSCA’s own policies and procedure.
    • Oversee and manage a professional team in a high-pressure and collaborative environment. 
    • Develop the FSCA’s regulatory framework strategy and approach and oversee the development and drafting of regulatory frameworks and related documents.
    • Ensure regulatory frameworks are developed in a manner that –
    • effectively supports the FSCA’s legislated objectives;
    • ensures alignment with international standards;
    • demonstrates harmonisation of laws and a shift to being more outcomes- and principle-based;
    • supports positive customer and country outcomes, including through enhanced consumer protection, as well as promoting sustainability, transformation,  of the financial sector;
    • supports financial capability, and inclusion;
    • does not inhibit innovation in the financial sector; and
    • enables proportionality, competition and contestability in the financial system.
    • Effectively promote and manage relationships with local, regional and international regulators, industry bodies, government departments and any other internal and external stakeholders,including overseeing participation in local and foreign initiatives, committees, conferences, meetings, and the like.
    • Oversee the provision of cross-departmental/divisional support.

    Junior Legal Assistant- Financial Services Tribunal (Pretoria)

    Purpose of the Job:

    • To render administrative and legal support and assistance to the Secretariat of the Financial Services Tribunal and Senior Legal Assistants. 

    Key Performance Areas:

    • Provide administrative support and basic legal support and assistance under supervision to the Financial Services Tribunal in terms of section 61(4), 288 and 304 of the Financial Sector Regulation Act 9 of 2017.
    • Prepare proper Tribunal records and ensure that such records are properly indexed and paginated.
    • Ensure that matters are properly placed before the Financial Services Tribunal.
    • Manage and maintain a proper filing system, both manually and electronically, regarding the Financial Services Tribunal matters.
    • Provide assistance to the legal adviser regarding the secretarial services of the Financial Services Tribunal;

    • Manage incoming and outgoing correspondence and telephone calls relating the tribunal processes and procedures, take comprehensive messages and referring matters to the Legal Secretariat or Legal Assistants.

    • Under general direction, performs a variety of complex and responsible legal, confidential and administrative functions.
    • Prepare reports and correspondence requiring knowledge of legal terminology and document formats, such as contracts, summonses, briefs, complaints and motions.
    • Manage the entire consultative process of legislation and subordinate legislation, ensuring that the media and applicable persons/organisations have been notified as well as monitoring that comments are received before the target date.
    • Respond to basic queries regarding the content of and progress of pieces of legislation.
    • Compile draft court documents (notices of motion, affidavits, draft court orders, abbreviated court orders etc.).

    Manager Retirement Funds: Frontline Prudential Supervision Department (Pretoria)

    Purpose of the Job: 

    • To supervise retirement funds through the analysis of statutory returns and on-site inspections. These inspections assists the Authority to gain insight on the operations of the fund; to detect and measure financial risks associated with the operation of the fund and its office bearers; and to identify the extent of the fund’s prudential compliance with the law.as it relates to fair outcomes for its members and beneficiaries. The person appointed to this position will report to the Departmental Head. 

    Key Performance Areas:

    • Lead and manage a dedicated team of specialists in the execution of the FSCA mandate; 
    • Ensure proper flow of work by prioritising tasks to ensure deadlines are met;
    • Equip team members with the necessary skills and knowledge;
    • Provide input to the Departmental Head for preparation of the team budget for the team to ensure that finances are available to carry out the duties effectively;
    • Demonstrate sound knowledge relevant to the employee’s work, including applicable law, the nature of the various types of retirement funds and the risks associated with the governance, management and operation of those funds and providers of products and services to them;
    • Work with colleagues to identify and evaluate such risks and formulate and revise strategies for risk-based supervision, implement them, report in writing on incidents of material non-compliance and make recommendations on the steps, if any, that should be taken in regard to those incidents;
    • Assist in the establishment and implementation of quality control procedures which govern the planning, execution and reporting of regular planned on-site inspections of funds that were classified as distressed entities;
    • To review and manage analysis of statutory returns, submissions and reports;
    • To review the processing of notifications and approve or reject applications;
    • To oversee the appointment, replacement and removal of curators;
    • To exercise oversight over and supervisory engagements with curators;
    • Overseeing funds that are placed under curatorship;
    • To manage the planning and execution of risk-based supervisory activities in relation to active funds and benefit administrators in accordance with the approved supervision plan
    • To allocate, monitor and manage special projects, high profile cases and ad hoc tasks;
    • To provide guidance to and facilitate compliance by regulated entities and persons;
    • To liaise with internal and external stakeholders;
    • To provide capacity building support and management;
    • Implementation of appropriate enforcement actions provided for in Chapter 10 of the FSRA;
    • Assist and oversee the referral and presentation of matters to the Regulatory Actions Forum Committee; and
    • Fulfil such other duties as may reasonably be assigned from time to time, considering the nature of the work, skills and experience and the mission of the Authority.

    Other Key Competencies:

    • The candidate must demonstrate the following skills and attributes: An excellent command of both spoken and written English and proficiency in the use of Microsoft Office and computerised workflow systems. Excellent skills in the investigation of facts and circumstances, the recordal of all relevant matters, the collection, organisation and protection of evidence that may be required for the purposes of regulatory action, legal research and factual analysis and writing and other forms of communication.     Manager Insurers Supervision Department (Pretoria)

    Purpose of the Job: 

    • To assist with the management of the department and to help develop and maintain an appropriate conduct of business supervisory framework for the insurance industry. The person appointed to this position will report to the Departmental Head. 

    Key Performance Areas:

    • Assist with managing the operations of the Insurers Supervision Department;
    • Assist with the development, implementation and maintenance of a risk-based conduct of business supervisory framework for insurers;
    • Assist in promoting the fair treatment of policyholders by insurers;
    • Oversee market conduct on-site compliance inspections where applicable based on policy and the risk-based supervision approach;
    • Provide inputs on projects identified in the Department;
    • Participate in the development and implementation of the FSCA’s digital transformation initiatives, including the Integrated Regulatory Solution (IRS).
    • Assist the Departmental Head by recommending and implementing changes to the regulatory framework and policy within the FSCA;

    Security Engineer: Analysis And Support (SOC) ICT Security Office (Pretoria)

    Purpose of the Job: 

    • The ICT Security Engineer: Analysis and Support, will play a critical role in safeguarding the organisation's information and cyber security posture. This position is primarily responsible for the Security Operations Centre (SOC) and support, cyber threat analysis and investigative activities to manage the security events and incidents.     • Coordinate the cyber security incident response (CSIRT), periodically update the cyber security incident response plan (CSIRP) and Crisis Management Plan (CMP) as required.
    • Coordinate the periodic security penetration testing and security vulnerability remediation activities.
    • Manage and maintain optimal performance of the Security Operations Center solutions (log collector agents, SIEM, XDR and Vulnerability Management)
    • Define and develop the annual cyber security awareness programme, calendar and publish awareness content to the organisation.
    • Perform a review of ICT security policies, standards and procedures as required and in line with industry frameworks (NIST CSF, ISO27001, COBIT).
    • Coordinate information technology general control (ITGC) requests for governance, assurance, business resilience audit and control assessments.
    • Collaborate with cross-functional teams to ensure security-by-design for project initiatives.
    • Prepare monthly operational ICT security and cyber threat intelligence reports.
