    Compliance, Contracts and Grants Manager

    Reporting to: Chief of Party

    No of Direct Reports: 4

    No of Indirect Reports: None

    Purpose of the position
    In collaboration with the Legal, Contracts and Grants Department, the Compliance, Grants and Contracts Manager will ensure that BroadReach complies with the rules and regulations of regulatory agencies, donors and company policies and procedures and that the behavior of the SA PEPFAR Country Programme meets the company's Standards of Conduct. The role takes responsibility for all the administration and ensuring compliance with legal, contractual and donor requirements across a portfolio of contracts, procurements and risk management.

    Key Accountabilities (included but not limited to)

    In Your Role You Will
    In your role as the Compliance, Grants and Contracts Manager you will:

    • Commercial Contracts and Independent Consulting Agreement Compliance
    • Administer Commercial Contracts and ICA systems and business vendor processes function
    • Ensure that all processes are formally documented and updated
    • Ensure that all invoices match scope of work and deliverables
    • Identify potential areas of contractual vulnerability
    • Ensure re-competitions and renewals are maintained according to internal regulation
    • Ensure due-diligence checks on potential vendors
    • Ensure all areas of business interest are comprehensively insured
    • Procurement and Vendor Contracting Compliance
    • Administer and monitor the procurement compliance framework and processes within BR on a departmental management level
    • Collaborate with department managers to resolve procurement compliance issues
    • Respond to alleged violations of rules, regulations, policies or procedures
    • Identify procurement compliance issues within the organisation and ensures that they are appropriately evaluated, investigated and resolved
    • Monitor and coordinates procurement compliance activities of other departments
    • Identify potential areas of procurement compliance vulnerability and risk
    • Contracts and Grants Management and Administration
    • Work with Business Units (e.g. operations/Program Management and Finance Departments) in reviewing budgets for contractual compliance and sound business practices (legally and in terms of writing)
    • Draft, negotiate and /or support effective negotiation of agreements, contracts, sub contracts, sub agreements and modifications/ amendments thereto
    • Identify and report to management on legal, compliance and contractual risks
    • Manage and escalate and drives resolution concerning contractual issues
    • Act as the main point of contact for LCG on a portfolio of contract or grants with donors, contractors, partners and BR technical staff
    • Monitor, manage and administer contracts, grants and sub-recipients across lifecycle of contract or grant (pre-contract through close out)
    • Ensure proper process and protocols observed throughout contract or grant life cycle
    • Educate and trains BR staff on effective contract and grant management and administration
    • Risk management administration
    • Ensure planning, designing and implementing an overall risk management process for the SA PEPFAR operations
    • Risk reporting in an appropriate way for different audiences, for example, to senior managers so they understand the most significant risks, to business heads to ensure they are aware of risks relevant to their parts of the business and to individuals to understand their accountability for individual risks;
    • Corporate governance involving external risk reporting to stakeholders;
    • Providing support, education and training to staff to build risk awareness within the organisation.

    • Monitor and review reports against deliverables
    • Report findings and progress on all contract, grants and ICAs with Programmatic and LC&G staff
    • Define report definitions and logic to meet reporting requirements
    • Ensure all reports of high quality and submitted timeously

    Qualifications

    Essential qualifications

    • Diploma in (Law, Finance and or Business Management) A Degree is an advantage either in Contract Management, Auditing and or Project Management

    •  

    Experience & Skills

    • Minimum of 10 years’ experience in overseeing contracts, grants and compliance for US government funded programmes
    • Ability to administer and understand contracts and grant clauses, terms and conditions
    • Risk identification, evaluation and measurement
    • Knowledge of complex automated financial & accounting systems;
    • Analytical skills with the ability to summarize and present information in a clear and concise manner
    • Project Management skills
    • Proficient presentation, speaking & written communication skills
    • Knowledge of applicable laws & local regulations in countries of operation
    • Knowledge of not for profit and for profit organisational regulatory requirements, policies and procedures
    • Knowledge of commercial contracting principles and governmental contracting, including but not limited to; OMB Circulars, Standard Mandatory and Required as Applicable Provisions, 2 CFR 200, 2 CFR 200 PART E & F, FAR, AIDAR and other Donor regulations
    • Knowledge of USAID and CDC rules and regulations
    • Ensure alignment with budgets, goals and work plans
    • Sound understanding of BroadReaches values, mission and culture
