Legal Advisor Office of General Counsel at FSCA South Africa

Purpose of the Job: 

• To provide legal support on litigation matters involving the FSCA, provide opinions and interpretation of legislation administered by the FSCA in support of the litigation unit in the Office of General Counsel.

Key Performance Areas:

• Provide legal advice, opinions, and interpretation of legislation to FSCA departments. 
• Analyse court judgments and decisions of the Financial Services Tribunal and advise on their impact. 
• Manage and support the management of litigation matters involving the FSCA including matters before the Financial Services Tribunal. 
• Represent the FSCA in reconsideration applications before the Financial Services Tribunal including the preparation of records of decision, consulting with FSCA personnel, consideration records in reconsideration applications and researching the law. 
• Draft legal documents, including submissions, affidavits, notices, heads of argument and correspondence concerning matters before the Financial Services Tribunal.
• Provide litigation support in High Court and other litigation matters. 
• Identify legal risks and recommend practical mitigation measures. 
• Liaise with internal stakeholders, the Tribunal Secretariat, and external legal service providers.

Requirements

• An LLB degree. Admitted attorney or advocate with about 2 - 5 years post admission civil litigation experience.  Knowledge and experience in civil litigation practice, including drafting court papers, legal documents, conducting legal research and providing legal advice. Experience in and knowledge of constitutional and/or administrative law will be an advantage. Experience in the regulation of the financial services industry and understanding of financial sector laws will be an advantage.
