    Junior Analyst X2 Retirement Funds :Transfers and Termination Department

    Purpose of the Job: 

    • To regulate and supervise retirement funds through monitoring compliance with the Pension Funds Act, Regulations, Conditions and Financial Sector Conduct Authority’s (FSCA) policy to safeguard the interest of both the members of the funds and funds through the analysis of financial statements, statistics, and reports; supervision of liquidations; extensions and exemptions related thereto. The persons appointed to the position will report to the Manager.

    Key Performance Areas:

    • Evaluating and analyzing financial statements of termination retirement funds.
    • Ensuring that legislation and the rules of funds are complied with when appointing liquidator. 
    • Assisting the Manager and HOD with ad-hoc requests.
    • Dealing with the administration and analysis of applications for extensions and exemptions.
    • Dealing with various liquidation correspondence, follow-ups and other administration functions. 
    • Undertaking projects at the request of the Manager or HOD; and
    • Assisting with the general regulation of Retirement Funds in as far as the termination and liquidation of termination of retirement funds is concerned.

    Other Key Competencies:

    • The candidates must demonstrate the following skills and attributes: An excellent command of both spoken and written English and proficiency in the use of Microsoft Office and computerised workflow systems, report writing, numeric, verbal and analytical skills; The candidate must be able to plan independently and be deadline driven, ability to work effectively, independently and in a team. The applicant must be willing to learn from others and transfer knowledge and skills to colleagues. A strong commitment to enhancing outcomes for retirement fund members and their dependants, combined with the energy, initiative, emotional intelligence, and interpersonal skills necessary to achieve these goals effectively.

    Requirements

    • A graduate with a BCom Degree and up to 1 year working experience. Candidates with good knowledge and exposure to the financial sector, as well as a good understanding of the Pension Funds Act of 1956 will have an advantage.

    Departmental Head: Frontline Conduct Supervision

    Purpose of the Job:

    • The Department Head is responsible for providing strategic leadership and regulatory oversight of retirement funds and benefit administrators on behalf of the Financial Sector Conduct Authority (FSCA). The role is accountable for ensuring the effective and efficient processing of regulatory notifications and applications, directing risk-based supervisory activities, overseeing statutory interventions, and promoting sound governance and compliance within the retirement funds industry. The incumbent plays a key role in the development and implementation of governance standards, member protection initiatives, and regulatory guidance, while working closely with internal and external stakeholders to manage risks and strengthen regulatory compliance. The person appointed to this position will report to the Divisional Executive: Retirement Funds Supervision.

    Key Performance Areas:

    • To ensure that the finances of department are managed in a responsible manner with the overall aim of achieving budget objectives;
    • To strategically direct the analysis of statutory returns, submissions and reports from retirement funds and benefit administrators;
    • To implement measures to ensure notifications and applications (including applications for exemptions and extensions) are processed in an efficient and effective manner;
    • To strategically direct the planning and execution of risk-based supervisory activities in relation to active funds benefit administrators and employers non-compliant with section 13A of the PFA;
    • To provide guidance to and facilitate compliance by regulated entities and persons;
    • To strategically direct the appointment, replacement and removal of statutory managers and section 26 boards;
    • To ensure accountability of and effective oversight over statutory managers, section 26 boards and trustees;
    • To develop, implement, and oversee governance principles, standards, and regulatory guidance for retirement funds, including drafting Guidance Notices and Conduct Standards in terms of the FSRA.
    • To monitor and assess compliance with the six Treating Customers Fairly (TCF) outcomes.
    • To oversee and enforce compliance with Section 13A of the PFA, including developing project plans in this regard.
    • To provide input on and oversee implementation of new legislation and Conduct Standards, including developing implementation plans in this regard.
    • To support the development, training (including the Trustee Training Toolkit), and have oversight of the conduct of trustees, including the evaluation and application of appropriate sanctions where trustee misconduct is identified.
    • To provide regulatory advice, opinions, and case support to the Retirement Funds Supervision Division and the Office of the General Counsel, including presentations to the Regulatory Action Forum (RAF) and assistance with Tribunal matters.
    • To ensure effective internal and external stakeholder management;
    • To provide capacity building support and leadership;
    • To consistently and properly apply the FSCA Performance Management System to all employees in the Department.

    Other Key Competencies:

    • The applicant must demonstrate the following skills and attributes: attention to detail, analytical mind, active listening, critical thinking, strong interest in research-related activities, high security appetite, excellent communication skills (verbal and written), innovative and strategic thinking. The following abilities are a must for the position: ability to work effectively under pressure with multiple stakeholders and in a professional manner; forward-looking and strategic minded, with an in-depth ability to understand potential risks, legal and compliance implications; ability to manage pressures of a large workload and to work independently and in a team; and ability to keep up-to-date with local and international developments and trends in the regulatory and supervisory space. 

    Requirements

    • A Degree in Law or Commerce or equivalent qualification; with at least 10 years relevant working experience within the retirement funds industry or the financial sector; of which 5 years must be at a management level. Knowledge and understanding of the Pension Funds Act, 1956 (PFA) and the Financial Sector Regulation Act, 2017 (FSRA) is a prerequisite. A post-graduate or professional qualification will be an added advantage.

    Legal Advisor Office of General Counsel

    Purpose of the Job: 

    • To provide legal support on litigation matters involving the FSCA, provide opinions and interpretation of legislation administered by the FSCA in support of the litigation unit in the Office of General Counsel.

    Key Performance Areas:

    • Provide legal advice, opinions, and interpretation of legislation to FSCA departments. 
    • Analyse court judgments and decisions of the Financial Services Tribunal and advise on their impact. 
    • Manage and support the management of litigation matters involving the FSCA including matters before the Financial Services Tribunal. 
    • Represent the FSCA in reconsideration applications before the Financial Services Tribunal including the preparation of records of decision, consulting with FSCA personnel, consideration records in reconsideration applications and researching the law. 
    • Draft legal documents, including submissions, affidavits, notices, heads of argument and correspondence concerning matters before the Financial Services Tribunal.
    • Provide litigation support in High Court and other litigation matters. 
    • Identify legal risks and recommend practical mitigation measures. 
    • Liaise with internal stakeholders, the Tribunal Secretariat, and external legal service providers. 

    Other Key Competencies:

    • The candidate must demonstrate the following skills and attributes: High integrity, collaboration, excellent judgment; legal research and analysis, litigation management, legal drafting, communication and stakeholder engagement, problem-solving, attention to detail skills and the ability to work in a stressful environment.

    Requirements

    • An LLB degree. Admitted attorney or advocate with about 2 - 5 years post admission civil litigation experience.  Knowledge and experience in civil litigation practice, including drafting court papers, legal documents, conducting legal research and providing legal advice. Experience in and knowledge of constitutional and/or administrative law will be an advantage. Experience in the regulation of the financial services industry and understanding of financial sector laws will be an advantage.

    Specialist Software Engineer (Magic: Fixed Term Contract) ICT Operations Department

    Purpose of the Job:

    • To apply system solutions to business problems through the design and programming of automated systems. To configure, analyze, design, develop, and maintain in-house developed applications to support business processes and functions. The person appointed to this position will report to the Senior Manager: Applications and Maintenance Support.

    Key Performance Areas:

    • Leverage knowledge of application architecture, databases and development techniques to design technical solutions to satisfy business requirements;
    • Program applications according to specifications and design.  The various modules must integrate with business processes. Test the functionality with special data in the development environment. Demonstrate new functionality and assist users with testing in a test environment;
    • Fix problems with applications and change functionality according to changing business requirements. Work according to the change management procedures of the ICT Department;
    • Develop interfaces and link different components with each other and with workflow;
    • Train users to utilise in-house applications and provide general support to all application related problems;
    • Keep up to date with new developments in the ICT industry (e.g. programming techniques, best practices, etc.) by studying technical manuals and magazines and attending special training.

    Other Key Competencies:

    • The candidate must demonstrate the following skills and attributes: Adherence to principles and values, apply expertise and information gathering and problem analysis, good judgement, following instructions and procedures, teamwork, positive attitude and willingness to learn; ability to evaluate, provide recommendations and implement third party solutions; ability to prioritise and perform multiple tasks in time-critical situations.

    Requirements

    • A bachelor’s degree in computer science, Information Systems, or another related field or equivalent qualification with at least 7 years’ development experience using the Magic development platform OR at least 10 years’ development experience using the Magic development platform in the absence of a formal qualification. 
    • ITIL Foundation certification would be advantages.
    • Exposure to integration services (e.g. SOAP, REST etc.) would be advantages.

    Executive Secretary Divisional Executive: Enforcement

    Purpose of the Job: 

    • The incumbent will be responsible for providing administrative support to the Divisional Executive: Enforcement and to ensure that office operations within the Division are efficient and successful in supporting business activities and vision. The person appointed to this position will report directly to the Divisional Executive.

    Key Performance Areas:

    • Any other official responsibilities delegated by the Divisional Executive.

Good interpersonal skills, office administration and communications (both verbal and written) skills; ability to organise and liaise well with people at all levels; ability to function under pressure and monitor projects as assigned.

    Requirements

    • A relevant qualification – including but not limited to secretarial, office administration, business administration. At least 15 years’ relevant working experience as a personal assistant, secretary, office administrator etc. Must have excellent organisational and communication abilities. Must have time management skills 
    • Advanced proficiency in the Microsoft Office programs (Word, Outlook, Teams, PowerPoint, Excel and OneDrive) and other computer applications.
