    Senior Commercial Manager (Bulk Civils Contracts NEC ECC) – Durban

    • The Senior Commercial Manager will take overall responsibility for managing the commercial aspects of the project in compliance with the NEC3 Engineering and Construction Contract (ECC). The incumbent will ensure that the project adheres to contractual, financial, and legal requirements while maintaining alignment with the Employer's objectives. This role demands extensive expertise in NEC3 ECC, the ability to effectively manage risks and claims, and a proactive approach to maximizing value for the Employer and the project team.
    • 2 year Project
    • Based in Durban (must live in Durban or have own accommodation)
    • BSc or B-Tech degree in Civil Engineering, Quantity Surveying, or Construction Management.
    • Minimum 10 years of experience in the built environment, focusing on large-scale infrastructure projects.
    • At least 8 years of experience working with NEC3 Engineering and Construction Contracts, with demonstrated expertise in the selected option

    Professional Registration:

    • Membership with a professional body such as RICS, ASAQS, or SACPCMP.

    Technical Competencies:

    • Comprehensive understanding of NEC3 ECC, including early warnings, compensation events, and contract administration.
    • Strong expertise in cost control, budget management, and financial reporting.
    • Proven ability to resolve claims and disputes within the NEC3 framework.
    • Excellent negotiation and communication skills.
    • Strong analytical abilities with attention to detail.
    • Leadership and team management capabilities.

    Preferred Additional Skills

    • Proficiency in commercial management software (e.g., CATO, Candy, or SAP).
    • Experience in the water infrastructure sector, particularly reticulation and bulk water pipelines.
    • Timely and accurate administration of NEC3 ECC commercial requirements.
    • Delivery of the project within the approved budget and financial parameters.
    • Successful resolution of claims and disputes with minimal disruption to the project.
    • Positive feedback from stakeholders regarding the commercial management process.

    Contract Administration

    • Manage all commercial aspects of the NEC3 ECC, focusing on the selected contract option.
    • Ensure compliance with contractual obligations, including notifications, cost reporting, and performance monitoring.
    • Oversee the preparation, review, and submission of contractual documentation, including compensation events and early warnings.

    Cost Control and Budget Management

    • Establish and monitor budgets for all project phases, ensuring alignment with approved cost plans.
    • Conduct regular cost forecasts and variance analyses to identify potential overruns or savings.
    • Ensure that payments and valuations are conducted accurately and on time, in compliance with the contract.

    Risk and Opportunity Management

    • Identify, evaluate, and manage risks and opportunities associated with the contract.
    • Develop mitigation strategies to address potential cost or schedule impacts.
    • Monitor and resolve commercial risks throughout the project lifecycle.

    Claims and Dispute Management

    • Lead the preparation and resolution of claims, ensuring compliance with NEC3 ECC procedures.
    • Develop robust records to support claims and disputes.
    • Negotiate settlements to protect the project’s commercial interests.

    Stakeholder Engagement

    • Act as the primary commercial liaison between the Employer, contractors, and project stakeholders.
    • Ensure clear communication and alignment on commercial objectives and challenges.
    • Build and maintain strong relationships with stakeholders to ensure smooth commercial operations.

    Team Leadership and Development

    • Lead and mentor the commercial management team, fostering professional growth and ensuring alignment with project goals.
    • Provide guidance on NEC3 ECC processes and best practices to project personnel.

    Reporting and Documentation

    • Prepare detailed monthly commercial reports, including cost forecasts, cash flow analyses, and risk updates.
    • Maintain comprehensive records of all commercial activities for audit purposes.
