    Head Mine Closure

    OPERATING ENTITY:         UBE: Mining (Various Mines)

    Sasol Mining operates a number of coal mines that supply feedstock to the Secunda (Sasol Synfuels) and Sasolburg (Sasolburg Operations) complexes in South Africa. The coal that is supplied for Sasol Synfuels is mainly used as gasification feedstock while some is used to generate electricity. The coal Sasol supplies to the Sasolburg Operations is used to generate electricity and steam. Sasol also export coal from the Twistdraai Export Plant to international power generation customers. Mining activities commenced in 1952 in Sasolburg and in 1960 in Secunda. Some mines have subsequently reached their Life of Mine and are currently in the process of undergoing a decommissioning and remediation process with the aim of achieving sustainable closure and a closure certificate. 

     

    ABOUT THE ROLE / PURPOSE OF THE JOB

    The purpose of Mine Closure Department is to support a step change in business performance by developing the organisation’s capability to manage risks and exploit opportunities. Sasol’s current portfolio of assets include a number of mining and processing operations in the Secunda and Sasolburg areas. These mines are associated with significant mining related land and water exposures, legacies and opportunities. Although most operations have completed risk based mine closure plans aligned with Sasol 7x7 risk matrix, there is variability in the quality of the plans and the identification and implementation of action plans to improve mine closure planning over the life of Sasol mining. This leaves Sasol mining exposed to under or over representation of closure provision. Potential opportunities to reduce the final closure liability of the life of a mining right are not always directly evident, or where evident, not consistently implemented.

    The Sasol mining closure department has developed a risk based approached aligned with R1147 financial provision legislation. This system has a particular focus on the integration and LoM planning to realise opportunities and realise value for the business.

    The mine closure discipline and legislative requirements are undergoing constant change, which will impact on the company’s current and future ability to manage long-term liabilities and maintain its license to operate. All these changes have the potential to generate additional challenges and opportunities in relation to mine closure planning and implementation. This role needs to champion and deliver a step change improvement in mine closure planning and execution across Sasol mining.

    The purpose of the role is to ensure that Sasol mining operations have stand-alone mine closure plans fully aligned to the risk based approach for the R1147 and in doing so ensure that closure liabilities are kept as low as possible, are accurately calculated, financial provision is in place and legal compliance is maintained. The role also entails integration of closure planning into LoM planning to generate value or prevent value destruction and the optimization of operational synergies that will reduce operational costs. The purpose of this role is also to ensure integration between disciplines across the operations to ensure mine closure is understood and embraced by other disciplines. This role will also be responsible for piloting new ideas, opportunities and technologies that will improve the mine closure practise and performance across Sasol’s operations.

    The role is required to regularly present mine closure strategy and liability management to Executive Management team.

    • Prepare and coordinate financial audit requirements for Sasol Mining when scheduled

    • Demolishment of shaft infrastructure and manage process with relevant government departments
    • Apply for mine closure certificate after decommissioning
    • Implement monitoring protocols to monitor the success of remediation actions

    Minimum Qualifications and Experience required

    • Relevant B Degree in Mining Engineering, Mine Planning, Environmental Science or other relevant discipline.
    • A postgraduate qualification in a relevant technical discipline is desirable.
    • Knowledge of the relevant South African environmental legislation including the Mine Health and Safety Act.
    • Typically, 10 years relevant experience in the field.

    KEY COMPETENCIES REQUIRED  

    • Demonstrated application of academic qualifications through experience working in the field.
    • Demonstrated experience working in an operational mining environment preferably with the relevant commodity.
    • Track record of leading ideas generation, translating these into practical initiatives to be implemented and demonstration of successful execution and delivery in the field.
    • Demonstrated experience in a senior people leadership role within a technical environment including the coordination of knowledge sharing within a sub-discipline, managing workload and reviewing the work of others to ensure consistency with task requirements. This includes project management by interacting with multiple consulting disciplines and external specialist.
    • Specialist knowledge in mine closure, within a large-scale mining or industrial context. An understanding of appropriate regulations and legislation relevant to mine closure.

    ABOUT THE ROLE / PURPOSE OF THE JOB

    Implementing and maintaining systems, processes, procedures and controls to mitigate the Customs & Excise non-compliance risk and ensuring compliance at all times. 

    KEY PERFORMANCE AREAS

    • Develops a business compliance universe for the Sasol Energy business (in terms of the Customs & Excise Act & Rules and any related legislation, including the identification of mitigating controls).
    • Collaborates with Sasol Group Compliance to monitor and facilitate Sasol Energy’s compliance with the Customs & Excise Act & Rules and related legislation.
    • Review and approve the monthly DA160 SARS Petroleum Accounts (Secunda and Natref including Natcos) in detail for compliance to the Customs & Excise Act, accuracy of the DA160 Petroleum Account and adequacy of the supporting documentation, thereby managing and mitigating Sasol Energy’s compliance risks in terms of the Customs & Excise Act.
    • Facilitate and establish constructive relationships with internal stakeholders, including:
    •  Business Units and Relevant Functions;
    •  Group Tax PSS Specialists – necessary consultations on matters that require their input to ensure sound governance;
    •  Group Compliance; and
    •  Sasol Legal Services.
    •  Facilitate and establish constructive relationships with external stakeholders, including:

      The South African Petroleum Industry Association’s (SAPIA) Tax Forum – represent and actively participate at these meetings to ensure that Sasol Energy’s concerns are raised on matters affecting the oil industry, to provide input in respect of such matters, to gain insight regarding future SARS and legislative developments

    • Engage with SARS regarding Customs and Excise matters to obtain the best possible outcome for Sasol Energy
    • Co-ordinates, interfaces and negotiates with SARS on SARS audits at the Secunda, Natref, Natcos and Sasol Energy.
    • Interfaces with other Oil Companies on industry specific issues relating to Customs & Excise
    • Attends meetings with external lawyers and Senior Counsels on matters relating to lawsuits against Sasol Energy to ensure success for Sasol Energy as follows:
    • Attend to actions taken before, at and after meetings
    • Plans and co-ordinates relevant meetings with internal stakeholders / external stakeholders
    • Presents an overview of the relevant provision of the Customs and Excise Act and Rules.
    • Provides detailed explanations of the relevant sections of the Customs and Excise Act & Rules, Sasol Energy’s internal operations and processes, what controls are in place to identify compliance risks and implement appropriate controls to ensure that Sasol Energy comply with the requirements of Customs and Excise Act and Rules.
    • Establishes and maintains a document management system for Customs & Excise matters, including engagements with SARS.
    • Provides specialist business advice in relation to Customs and Excise compliance matters, including the analysis of complex questions raised by internal / external stakeholders and providing specialist business advice in response thereto.
    • Maintain expert knowledge of the Customs & Excise Act, Central Energy Fund Act, Civil Aviation Authority Levies Act, Petroleum Products Act and applications thereto.
    • Continuously evaluates SARS queries to establish the merits, the applicable sections of the Customs & Excise Act, drafts responses to SARS, obtain inputs from other stakeholders (legal advisors, Consultants, General Manager Finance: Group Tax) to ensure compliance.
    • Collates, validates, analyses, interprets information from different departments for management reporting as well as to serve as the basis for the business results;
    • Ensure timeous response to queries from Statutory and Regulatory bodies (including NERSA and DOE)
    • Assesses changes to the Customs & Excise landscape and advises the business accordingly to ensure compliance.
    • Reviews and provides inputs and comments into transporters, clearing agents’ and sales contracts to facilitate compliance to the Customs & Excise Act and Rules.
    • Advises, develops and maintains internal controls to meet the Customs and Excise and other regulatory compliance requirements and to mitigate potential risks.
    • Develops, implements and monitors a co-ordinated Southern Africa Energy Customs & Excise compliance framework to ensure compliance to the Customs & Excise Act
    • Continuously provides general and specific Customs & Excise training to new and existing employees at Sasol Energy as well as the refineries (Secunda, Natref and Natcos) to ensure compliance with the Customs & Excise Act & Rules
    • Consults with Sasol Energy’s Legal Advisor (Legal Services) regarding any Customs & Excise Act & Rules matters requiring legal advice 
    • In collaboration with Legal Services (unless if agreed otherwise), consults with and manages the deliverables and fees of external consultants on technical aspects of the Customs & Excise Act & Rules to ensure compliance with the Customs & Excise Act & Rules. This is done especially on ad hoc queries and changes to the Customs and Excise Act & Rules in consultation with Legal Services.
    • Manages and performs random compliance audits, including refinery visits, to facilitate compliance with the Customs & Excise Act and Rules. 
    • Prepares and contributes to accurate and timely papers for the Board and Governance Committee meetings.
    • Review cash flow forecasting and ensure accuracy thereof.
    • Perform internal financial and SOX controls and quarterly SOX testing.
    • Maintains controls regarding adherence to SOX 404 requirements.
    • Review monthly General ledger reconciliations.
    • Ensure that the DAS liability and related GL reconciliations are performed and correctly accounted for.
    • Prepares journals for posting/authorisation in ledger
    • Review year IOPCF SARS return for completeness, accuracy and compliance.
    • Ensure that sound financial accounting principles and practices are implemented and applied.
    • Adherence to SHER requirements.
