    Legal & Claims Officer

    Job Purpose    

    • A exciting position of Legal and Claims Officers exists in our Road Freight and Warehouse Operations. The purpose of the position is to manage the claims process, authorise service provider contracts and assist with legal debt recovery . The successful candidate will be based at our Jacobs Offices and need at least two years corporate legal insurance experience preferably in the logistics or freight environment. Suitably qualified candidates are invited to apply to be part of this dynamic team.

    Qualifications & Experience    

    • LLB degree 
    • Shipping / marine law or insurance diploma / certificate
    • At least two years corporate legal or insurance experience
    • Previous work experience in a logistics or freight environment preferable

    Key Responsibilities    

    • Claims
    • Assist with the overall administration of insurance claims, including negotiating settlements with underwriters                                                 
    • Continuously follow up with insurers with regards to the queries and investigating the matters to determine liability.                                
    • Work closely with the company’s underwriters, insurance brokers as well as loss adjusters as when required.                                 
    • Address clients queries with reference to claims.                                
    • Liaise with all role players where applicable, i.e. airlines and transporters                                                                
    • Provide feedback to Operations regarding claim trends, and assist with root cause analysis to avoid repeated incidents                                

    Service Providers

    • Oversee the receipt and logging onto the register of all new and amendment service provider requests                                
    • Assist in procurement process - on boarding of service providers                                
    • Vet and authorise contracts in line with the authority levels matrix                                                              

    Debtors

    • Liaise with the credit and operational teams regarding details                                
    • Deal with the attorneys, business rescue practitioners or liquidators to finalise any claims                                

    Other

    • Analyse legal and risk implications of various issues and advise internal stakeholders                                
    • Responsible for drafting and vetting agreements and legal contracts, relating to clients, service providers and other business partners           
    • Prepare monthly and quarterly reports for management meetings                                
    • Provide legal advise and support to management and business                                
    • End-to-end management of all agreements and contracts                                                                                                                              
    • Maintain and communicate supplier and client contract end dates, as well as company subscriptions                                                              

    Skills & Competencies    
    Knowledge:

    • Shipping law, including international conventions covering air and ocean freight                                
    • Insurance, in particular cargo cover and marine                                
    • Commercial contracts                                
    • Knowledge in legal aspects relating to the NTRA - will be preferable                                
    • Debt recovery                                

    Skills:

    • Communication, in particular negotiation of claims                                
    • Vetting of contracts                                
    • Strong organisational and time management skills                                
    • Use of excel and reporting

    SHERQ Co-ordinator

    Job Purpose    

    • BIL has an opportunity for a SHERQ Coordinator who will assume full responsibility for all aspects of the SHERQ programme at BIL Warehouse under the incumbents control to ensure that they comply with statutory, legal, ISO and other relevant requirements, safely and in accordance with the organisations Policies, Standards and Procedures.

    Qualifications & Experience    

    • Grade 12
    • Degree/Diploma in Disaster and Safety Management or equivalent
    • Minimum SAMTRAC/NEBOSH qualification.
    • South African Institute for Occupational Safety and Health (SAIOSH) professional registration in good standing
    • Qualification in Implementation and Evaluation of Quality Management Systems
    • Qualification in Implementation and Evaluation of Environmental Management Systems                

    Key Responsibilities    

    • Operational Activities
    • Review, update and monitor the management review pack and feedback to facility managers on outstanding items or improvements
    • Monthly submission of Management review pack to C&R prior to deadline
    • Behavioural Observation: Monthly Review of SHE Risk register and Identify common behaviours and present to site management for input and comments
    • Sign-off site specific 31(2) agreements and assist in gathering all documents from the creditors for BIL procurement creditor onboarding
    • Ensure Planning and coordinating of safety drills and debriefing sessions after emergency drills are done bi-annually
    • Conduct induction for contractors and assist with RA as and when required
    • Participate in SHE work plan for contractor management
    • Ensure that where specific authorization are required in terms of SHE legislation that process is managed and relevant permits and authorizations are obtained prior to project commencement
    • Assist with the review of creditors-procurement documents as and when required
    • SHE induction of new employees and contractors and conduct annual refreshers
    • Ensure notification of all IODs to site management, National SHERQ and employee benefits department
    • Obtain monthly legislation updates, permits and upload on DGH
    • Maintain permit register on MRP
    • Assist in obtaining quotes to repair where damages have been identified as orange or red from the racking inspector
    • Ensure that all lifting equipment is load tested in accordance with the manufacturers requirements
    • Monitor calibration status on scales
    • Obtain quotes for repairs and calibration of scales, and send invoices to finance
    • Assist in the procurement of operational equipment such as pallet jacks, scales, ladders, racking, AC units etc.
    • Obtain quotes for fencing of cages and repairs within the warehouse, serge protectors etc as and when required
    • Pest control quotes are obtained, meeting with service providers to arrange for Po's and internal docs
    • Compile maintenance budget
    • Review and amend SLA's
    • Ensure that all lifting equipment is on planned maintenance schedule

    SHERQ MANAGEMENT

    • Support Facility Managers in their responsibilities to implement and enforce SHEMS,QMS and their requirements
    • Ensure that operational and SHE inspections are done
    • Provide guidance to facilities on SHERQ matters and ensure relevant SHERQ communication and awareness material is distributed to all employees on site
    • Ensure that medical register is updated and that medicals are done annually
    • Review contractors health and safety files
    • Ensure that permits to work are in place for all work taking place on site
    • Management of contractors in line with BIL policies and procedures
    • Perform inspection verification of stock compatibility and segregation within the warehouse
    • Ensure that you issue the required HCS personal protective equipment as and when required and ensure adequate supply and back up of PPE
    • Maintain the sites dangerous goods register of category A and B substance
    • Attend and participate in monthly facility SHE Committee meetings, Site  Management Meetings and if required client meetings i.e. SHE Com Meeting BIL facilities that are on clients sites.
    • Review Standard Operating Procedures (SOPs)                                                                                             

    Training

    • Manage all the facilities SHERQ training records and co-ordinate specific training requirements through the Bidvest IL Training Department.
    • Manage all the MHE license and training requirements through the Bidvest IL Training Department.
    • Coordinate training and assist with legal appointments
    • Conducting BIL SHEQ Employee Induction including HCS requirements and Conduct Contractor Induction
    • Co-ordinate, plan and implement all HCS training requirements as per the sites skills.
    • Assist the facilities by facilitating the necessary SHEQ training required for legal appointees and training as per the requirements of the Compliance and Risk Department as indicated in Skills Matrix Tab in the Management Review Pack.

    Skills & Competencies
