    Contracts & Transactional Support Mngr

    About the Job

    Position Purpose:

    • To drive an efficient management and operational support system that is focused on the effective development and implementation of national procurement contracts. This includes knowledge and analysis of materials to be placed on contract, ensuring tender documents issued are legally and technically compliant, issuing and evaluation of tenders, creating contracts for legal vetting and overseeing the process for loading of contracts on SAP, and management until expiry.

    Position outputs:

    • Create a long-term and medium-term plan for creation of national contracts and ensure that resources are sufficient and competent to support departmental requirements.
    • Consolidate requests for creation of contracts, nationally in conjunction with the Specialist: Contract Management.
    • Manage the contract development function and champion the standardisation of contract development at the Division according to Transnet policies and strategy.
    • Work closely with Specialist: Contract Management to ensure that appropriate effort is put into developing contracts that fit in with line priorities.
    • Track contract development at the Corridor, giving support to Regional Contract Managers as requested, in liaison with Specialist: Contract Management.
    • Establish quality control measures for issuing of tenders and enforce such measures.
    • Establish clear adjudication criteria for award of tenders, including additional specific requirements (e.g. PCI, performance guarantees, CIDB certificates, etc.).
    • Review and amend contract and supporting documents within specified timelines.
    • Ensure contract management processes are monitored and aligned to the contract terms and conditions.
    • Develop and implement contracts in line with purchasing strategies/plans.
    • Ensure that contracts specify the outcomes required, together with clear criteria relating to costs, quality assurance, service standards.
    • Ensure that contracts specify arrangements for regular monitoring and that formal review meetings are held as per schedule.
    • Contribute to the development, review, and approval of new or improved procurement policies and procedures from a contracts management perspective.
    • Verify that invoices and payments are financially and procedurally correct, that is, in conformity with the contract and the regulations, including documentation, data and figures.
    • Verify the forecasts of revenue and recovery orders
    • Maintains a detailed contract register for contracts under management.
    • Ensure that all contracts are loaded on SAP/3.
    • Effectively manage contracts to expiry.
    • Develop, roll out and manage a contract lifecycle management system.
    • Work closely with all stakeholders — e.g. Tactical Procurement / Strategic Sourcing, Engineering, Finance — to expedite contract development and management processes
    • Manage interactions with key suppliers to resolve disputes around operational issues.
    • Develop a system to gather and communicate supplier performance information to critical stakeholders
    • Conduct training and awareness sessions on applicable internal and external policies, regulations and laws that impact on Contract management and monitor and report on progress with achieving of targets.
    • Demonstrate continuous effort to improve operations, decrease turnaround times, streamline work processes and work cooperatively and jointly to provide quality seamless customer service.
    • Advise clients and Tactical Procurement / Strategic Sourcing teams on courses of action related to claims and contractor non-performance.
    • Maintain liaison with purchasing representatives of other SOEs to benchmark consistency in procedures
    • Liaise with Legal Department in interpretation of contract clauses and contract legal dispute resolution.
    • Chair and organise claims meeting.
    • Conduct claims administration and ensure compliance to TPT Claims Procedures and relevant S.A. legislation.
    • Create responses to non-routine correspondence and handles special assignments and problems such as responses to inquiries and bid protests
    • Report on monthly basis all contracts’ activities and attend monthly contracts review meetings with national business.
    • Complete and issue a Contract Review Record and ensures that relevant issues from the review are fed back into the procurement process.
    • Undertakes compliance action where appropriate
    • Supervises and participates in the preparation of written financial and administrative reports.
    • Interprets contract provisions and clauses where disputes arise and reviews contracts for accuracy and changes prior to award and renewal.
    • Analyse, identify and mitigate legal risks and implications on contracts
    • Oversee contract management process and manage contract management process in respect of concluded agreements in Supply Chain Management.
    • Commodity TCO and Lifecycle costs management of Supplier Dependency ratio and provide mitigation measures Support SD team in enforcing and tracing supplier's BBBEE Improvement plans and other economic development commitments through the contract period.
    • Review contractor's annual escalation process and provide indices market intelligence Facilitate and Manage supplier legal disputes matters through legal department Provide inputs and implement contract management strategy approved by Senior Manager Contract Management.
    • Develop and Manage supplier performance management dashboard.
    • Identify risks & mitigation measures Review TDR before RFP/RFQ are issued in order to recommend correct Contract template to be used.

    Qualifications & Experience:

    • Bachelor's degree in supply chain management, Logistics & Operations, Commercial, Engineering, Legal or Financial
    • OR
    • National Diploma in Commerce or Finance including a minimum of Level 4 CIPS Diploma
    • A post Graduate Degree in Supply Chain Management, Law, Business Management, Finance, Commercial, MCIPS will be
    • an added advantage.
    • At least 6-8 years’ experience in managing the tender and contracting process and in administering contracts within
    • procurement environment with at least 3 years at managerial level.
    • Requirement of Trust and Honesty in the handling of Finances as per the National Credit Act Amendment 19.
    • Willing to undergo State Security Agency (SSA) Vetting
    • Minimum Driver’s License (Code 08).
    • Travel as Required and Approved.

    Knowledge:

    • Experience in application Transnet’s Procurement Procedure Manual.
    • Experience in a Procurement environment and knowledge of procurement legislation, and its application (Public Finance
    • Management Act (PFMA), CIDB Act, BBBEE Act, PPPFA Act, CSDP, PSIRA).
    • Experience in the adjudication of tenders and placing of contracts.
    • Commercial contract management Knowledge.
    • Good negotiations skills.
    • Experience in contractual dispute resolution.
    • Sound Knowledge of contracts law.
    • Working Knowledge in NEC3 suite contracts

    (Readvert) Specialist: Occupational Hygiene Technical Management

    About the Job

    Position Purpose:

    • Lead the development and implementation of the Occupational Hygiene technical management programs from
    • Identification, Risk Assessment, Inventory register, Hygiene Surveys and Audits across Transnet, whilst providing guidance and assurance to the Operating Divisions (ODs).
    • Contribute technical specifics in the development, implementation, management, and maintenance of Occupational Hygiene policy, procedures, guidelines, programmes and ensure the provision of high-quality Occupational Hygiene service.
    • Responsible for maintaining the Transnet Accreditation and Registration as an Approved Inspection Authority (AIA) for Occupational Hygiene through the implementation and maintenance of the Occupational Hygiene quality management system in line SANS 17020 requirements, supplementary contract management and ensuring compliance with the accreditations standards.
    • Specialist contributor to the development and driving the Occupational Hygiene culture, which enables Transnet to provide and maintain safe working environment without Occupational Hygiene related stressors.

    Position outputs:

    • Develop, implement, manage and maintain a risk-based occupational hygiene programme throughout Transnet, and to ensure that all workplaces and buildings comply with statutory requirements.
    • Develop, implement, and maintain occupational hygiene Standard Operating Procedures (SOP) for all occupational hygiene surveys.
    • Setting specific performance objectives and targets for the quality management system and ensuring the implementation thereof.
    • Guide Transnet OD’s to develop a risk-based occupational hygiene program.
    • Develop, implement and maintain occupational hygiene standards, guidelines, standard operating procedures, templates, checklists, field sheets, forms and in-house occupational exposure limits.
    • Develop, implement and maintain a mentorship and coaching program for up-and-coming Occupational Hygiene employees to ensure that occupational hygiene standards are not compromised or deviated from when carrying out occupational hygiene surveys.
    • Develop and implement a program for technical field audits and observations and conduct field audits and observations on all occupational hygiene employees performing inspections.
    • Ensure that all new employees are provided with training before any survey is carried out by them, this will promote alignment, uniformity, and standardization in conducting surveys in line with occupational hygiene quality management system.
    • Conduct ad-hoc occupational hygiene surveys including workplace investigations and reporting on all occupational hygiene related activities. Prepare reports on the results and findings and analyse and interpret data to draw meaningful conclusions.
    • Advice on occupational hygiene related issues and give sound professional advice and judgment to clients to implement recommendations, corrective and preventive actions to line management on occupational hygiene related aspects.
    • Implement and maintain the Occupational Hygiene Management Policy.
    • Identify, anticipate and track technological, legislative and toxicological changes and developments to updated knowledge, occupational exposure limit modifications and changes to inform monitoring strategies and programs.
    • Conduct audits and Identify interventions to address occupational hygiene non-conformances and address and implement corrective and preventive actions. Monitor the occupational hygiene deviation management system in order to track the implementation of control measures.
    • Integrate Occupational Hygiene function with the Safety, Occupational Health and Wellness functions to ensure that exposure data and medical surveillance outcomes are shared by both teams to continuously improve exposure controls and the development of Occupational Risk Exposure Profile (OREP).
    • Conduct Occupational Hygiene surveys, trends analysis and benchmarking across Transnet.
    • Occupational Hygiene Communication
    • Maintain world class practices through benchmarking, research and development in the field of Occupational Hygiene and to ensure that the AIA is in line with national and international best practices.
    • Develop and implement the quality management system in line with South African National Accreditation System (SANAS), ISO 17020 requirements and maintain accreditation as an AIA for Occupational Hygiene.
    • Coordinate external audits conducted by external AIAs.
    • Coordinate and participate in the annual and four yearly surveillance audits conducted by SANAS.
    • Compile a six-monthly report on the AIA activities or as and when required and submit to the Department of Employment and Labour (DoEL).
    • Act as a technical signatory for all occupational hygiene technical work by reviewing occupational hygiene reports.
    • Occupationa Hygiene Communication
    • Implement the Occupational Hygiene Communication programs across Transnet, communicate hygiene monthly themes, awareness campaigns and emerging trends.
    • Keep management and employees of Transnet informed on critical issues pertaining to occupational hygiene issues and drive knowledge, awareness and learning.
    • Monitor and ensure that the operating divisions comply with the Safety, Occupational Health and Wellness policies, processes and procedure concerning the implementation of Occupational Hygiene.
    • Responsible for communication initiatives and advice on Occupational Hygiene content development for introducing/maintaining best practice for the entire Transnet.
    • Manage Occupational Hygiene Resources and Enabling Services
    • Manage Occupational Hygienists, Occupational Hygiene Technologists, Occupational Hygiene Assistants (Young
    • Professional in-Training) and Occupational Hygiene Administrator to ensure that the key deliverables are executed in line with the business requirements.
    • Manage personnel and team’s performance about resource allocation and adjustment, internal training, scheduling of projects, etc. and accommodate professional development needs.
    • Manage and streamline procurement process of occupational hygiene support services (Calibration of equipment, new equipment, sample media and license fee for SANAS) to ensure occupational hygiene program is running without hindrance.
    • Ensure that the service providers deliver Occupational Health services as prescribed by the Service Level of Agreement (SLA).
    • Provide support and mentorship as necessary to ODs to develop effective working relationship.
    • Develop additional occupational hygiene capacity for Transnet ODs through training Occupational Hygiene practitioners and
    • provide support to occupational hygiene teams in the ODs to ensure occupational hygiene programs are properly embedded and implemented in Transnet.
    • Stakeholder Relations Management:
    • Engage all key stakeholders on an ongoing basis, and build trusted and valuable partnerships to establish sound relationships.
    • Collaborate with, and build solid relationships with key stakeholders and other functional areas to enable insight, understanding and effective functioning.
    • Governance, Audit and Assurance:
    • Take an active part in all Transnet, 3rd party and customer audits/visits, following up and completing all corrective actions with regards to Occupational Hygiene non-conformances.
    • Conduct regular compliance audit throughout the OD’s to ensure compliance to the occupational hygiene program and statutory requirements.
    • Ensure governed procurement practices are followed during purchasing of services and equipment. Participate in technical evaluations for tender bidding of service providers.
    • Develop scope of work, specifications and returnables for potential service providers.
    • Manage contractors and service providers to ensure that they deliver Occupational Health services as prescribed by the
    • SLA for outsourced services.

    Qualifications & Experience:

    • BTech/B Degree (Safety Management, Environmental, Occupational Health, Technical Sciences) is a consideration.
    • Masters in Occupational Hygiene/Public Health/ Occupational Health is desirable.
    • Have at least 5 years relevant experience and also registered as an occupational hygienist.
    • Have at least 5 years experience as a head for an AIA for Occupational Health and Hygiene (Accredited by SANAS and registered with the Department of Employment and Labour).
    • Have at least 8 years as a manager for occupational hygiene.
    • Have at least 5 years’ experience as a technical signatory for the AIA.
    • Legal knowledge certificate in Occupational Hygiene.
    • Be registered with the Southern African Institute for Occupational Hygiene (SAIOH) as an Occupational Hygienist.
