    Trademark Administrator

    Job description

    Role Purpose:

    To ensure efficient and effective support to the Legal Division for maximum output and to act as an intermediate between the Legal Division and Internal / External contacts. To take responsibility certain aspects of the Aspen Trademark Management System,  and to provide project coordination in respect of trademarks, patents and domain names related to Group Transactions.

    Specific Outcomes and Accountability:

    Provide efficient support to IP Manager which includes:

    • Assisting with matters in a timely and efficient manner;
    • Conveniently storing information for ease of access;
    • Collating and preparing information and files ahead of meetings and TC’s;
    • Complying with Aspen’s Legal Office Standard Operating Procedure (dated 1.9.2010);
    • Complying with the Legal Portal Procedures and Required Ways of Working.
    • Manage selected IP matters under guidance of the Legal Counsel - IP;
    • Take responsibility for and ownership of certain matters being run by external attorneys;
    • Accurately drafting correspondence and agreements meticulously in the correct Aspen format;
    • Ensure that all correspondence and agreements are accurately filed;
    • Ensure that working files are conveniently located;
    • Proactively discern priority of tasks, focus on high priority tasks first.

    General Trademark Administration

    • Adhering to the Aspen trademark search flow sheet and agreed WOW;
    • Attending to accurate and timely filing instructions in the agreed format and in accordance with the Trademark Filing Instruction Sheet;
    • Adhering to the Aspen trademark prosecution flow sheet and agreed WOW.
    • Accurate and timely invoice management;
    • Identifying general concerns.
    • Elevating any intellectual property related concerns to the Legal Counsel - IP.

    Administer Aspen Trademark Management System (“TMS”)

    • Attend TMS training sessions and ensure that personal expertise in TMS is such that further training can be presented to Legal Counsel and Trademark Administrators for Aspen affiliates;
    • Take responsibility for the on-going accuracy and integration of TMS records which includes:
    • Ensuring that all standing instructions with external IP service providers are updated to state that change in records should be communicated in the agreed manner;
    • Consolidating communications and updating records at least once a day;
    • Managing standard reports to ensure that all reports are sent to Aspen affiliates in a timely manner and in the agreed format.
    • Take responsibility for and implement any customisations to TMS as they arise, with a particular focus on ensuring that the agreed Aspen WOWs are implemented on standard TMS documentation.

    Transaction Trademarks

    • Promote support to and coordinate under guidance of the Legal Counsel - IP the trademarks analysis for potential transactions;
    • Where relevant communicate with project team and monitor trademark and patent implementation target.
    • Interface with Legal Stream and Stakeholders
    • Provide support by way of answering queries or sharing intellectual property, computer or system knowledge when requested.

    Requirements

    Qualification and Experience

    • Matric / Grade 12;
    • Trademark Qualification an advantage;
    • Legal Secretarial or professional qualification.
    • Experience in intellectual property matters with a specific focus on assignment recordal and bibliographical amendments to current trademark and patent records;
    • A basic understanding of foreign trademark filing and prosecution processes;;
    • Electronic and manual trademark filing and renewals;
    • A basic understanding of domain name management will be an advantage;
    • Familiarity with legal terminology an advantage;
    • 3 years’ experience in similar function;
    • Proven track record as a senior legal secretary and typist;
    • Relevant experience in a legal practice or corporate environment essential – experience with an international patent and trademark data management system:

    Skills and Attributes

    • Advanced PC literacy on all MS Word applications (including Windows, PowerPoint, Outlook and Excel);
    • Ability to decide, action and assess when to execute;
    • Minimum typing speed of 75 wpm;
    • Verbal and written proficiency in the English language.

    • Electronic database management;
    • Positive, diligent and hard worker;

    Knowledge:

    • Trademark process and exposure to Trademark Law;
    • Systems; Pharma and IMF Product knowledge; Industry understanding; Basic legal sense;
    • Knowledge of template development is an advantage;
    • Knowledge/expertise in: automatic numbering, track changes, comments in different formats, automatic cross-referencing, security settings on documents, ability to compare various document drafts essential.
