    Lead Legal RSA

    About the job
    OVERVIEW:

    • Responsible for directing and managing the legal & compliance functions in line with business requirements and objectives of PPC RSA.
    • Responsible for ensuring that legal risk (statutory) and compliance risk (company policies) are adhered to through the appropriate systems, teams/functions and processes
    • Maintain a regulatory universe with the RSA business and track compliance to this
    • Conduct compliance monitoring and ensuring that the compliance framework within the RSA business is comprehensive and robust and implemented
    • Partner with Group Legal and Compliance to identify areas of the business where there is a risk of non-compliance and develop/maintain policies to reduce that risk in
    • Plan communication and training programs to help employees understand their roles in compliance
    • Provide prompt professional and credible legal advice and effective legal support on topics as required (verbal and written opinions)
    • Advise and provide direction on tender processes where required
    • Provide support in terms of drafting, contract risk management and management of contracts. Introduce templates for contracts where feasible.
    • Responsible for continuous improvement within these functions
    • Manage and control the budget for the Legal and Compliance function as agreed
    • Effectively lead and manage teams, in line with PPC values, which may include both direct and indirect reports

    KEY OUTPUTS:

    • Lead EXCO approved legal and compliance systems (framework, tools, forums)
    • Prepare relevant submissions for RSA Mancom and ensure Mancom submissions intended for EXCO approval are duly tabled
    • Maintenance of the regulatory and compliance universe, ensuring the enforcement of compliance with regulatory universe and tracking and reporting on compliance (In collaboration with Group Compliance and Legal)
    • Identifying legal and compliance risks and ensuring that adequate mitigation steps taken.
    • Litigation and Legal disputes reporting (In collaboration with Group Compliance and Legal)
    • Perusing drafting and negotiating of all contracts
    • Adherence to all Group Legal and Compliance policies
    • Assist with Labour Relations - coordinating the implementation of Labour legislation, provide technical advice in preparing for annual wage mandating processing and collective bargaining negotiations.
    • Agreed actions/initiatives delivered within cost, timeline and quality expectations
    • Accurate and timely reporting
    • Budget management
    • Implemented BBBEE roadmap to support the scorecard elements
    • Ad hoc legal opinions (verbal and written)

    MINIMUM QUALIFICATION:

    • University degree, preferably in Commercial Law, B. Com Law or equivalent

    EXPERIENCE:

    • 5 years legal and compliance management experience within mining/manufacturing environment.
    • Demonstrable evidence of having worked in a role requiring extensive and continuous interaction with various internal and external stakeholders in delivery of objectives.
    • Extensive knowledge of procurement contracts, and knowledge of forms of construction contracts (NEC & FIDIC)
    • In-depth knowledge, understanding and application of BBBEE legislation, Amended B-BBEE Codes, policies and practices
    • Knowledge of DTI revised Codes of Good Practice (CoGP), the Mining Charter, Skills
    • Development Act, Employment Equity Act.
    • Data security
    • Demonstrable evidence of experience with Microsoft Office products such as MSWord,
    • Excel and PowerPoint.
