The vision of the ETDP SETA is to be a promoter and facilitator in the development and improvement of the skills profile of the sector's workforce to benefit employers, workers, and employees in the sector.
To provide strategic leadership and oversight of the (SCM) function through the development and implementation of procurement strategies, policies, and processes that comply with the PFMA, NT Regulations, the PPPFA, and other applicable legislation. The incumbent will promote good governance, transparency, value for money, and efficient procurement, overseeing strategic sourcing relationships.
Job Description
Conduct legal research and provide professional advice on legislation, regulations, case law, and other legal requirements applicable to the organisation.
Draft, review, and maintain standard ETDP SETA legal agreements and templates, including Service Provider Agreements, Suretyship Agreements, Service Level Agreements (SLAs), Memoranda of Understanding (MOUs), Memoranda of Agreement (MOAs), and other legal instruments.
Assist with the negotiation of contracts and agreements with relevant institutions and draft legal correspondence as required.
Review and vet contracts, agreements, leases, and other legal instruments to ensure that they are valid, legally binding, appropriate, and aligned with the organization’s interests.
Facilitate the execution of legal agreements and provide guidance to employees and stakeholders on the interpretation and implications of contractual provisions.
Identify, assess, and advise on legal risks arising from contracts, agreements, and organisational activities.
Draft, review, and provide legal and compliance input into organisational policies, procedures, and governance documents.
Provide legal support in the management and resolution of disputes, including conducting relevant research and recommending appropriate courses of action.
Coordinate and respond to legal correspondence, including letters of demand, summonses and administer other court processes, and ensure that matters are appropriately escalated.
Liaise with external attorneys, advocates and legal advisors on specialised legal matters and prepare comprehensive briefs and supporting documentation where required.
Maintain and monitor litigation, dispute and legal matter registers and provide regular updates on outstanding matters.Conduct compliance risk assessments by identifying, analysing, evaluating, and monitoring compliance risks affecting the organisation.
Maintain and consolidate the organisational compliance universe and compliance profiles, ensuring that applicable legislative and regulatory requirements are appropriately monitored.
Develop, implement, and monitor compliance programmes and action plans aimed at preventing and minimising instances of non-compliance.
Monitor compliance with applicable legislation, regulations, rules, codes, standards, policies, procedures, and report identified non-compliance to the Line Manager.
Maintain compliance with risk management plans and monitor the implementation and closure of corrective actions.
Provide advice and support to business units on compliance matters and assist in addressing identified compliance gaps.
Research and benchmark best practices in legal compliance and corporate governance and recommend appropriate practices for adoption by the organisation.
Facilitate compliance awareness and training initiatives in collaboration with Human Resources and relevant stakeholders.
Compile monthly, quarterly, and other periodic legal and compliance reports for management, the Risk Management Committee and other relevant governance structures.
Maintain accurate and confidential legal, compliance, contract and governance records and registers.
Promote a culture of legal and regulatory compliance by providing guidance and support to internal stakeholders and ensuring that legal and compliance matters are handled professionally, efficiently, and confidentially.
Perform any other duties and responsibilities that are related to the position, as may be assigned by the Line Manager from time to time.
N/B: The successful candidate will enter into a performance contract with the ETDP SETA.
Job Requirements
A Bachelor of Laws Degree, LLB or B. PROC equivalent recognized legal qualification at NQF Level 7.
At least five (5) years’ working experience in a legal environment in contract management, litigation and/or regulatory compliance experience.
Experience in developing and managing compliance monitoring programmes and reporting.
Proven experience in coordinating compliance issues at an organisational level
Strong contract drafting skills on commercial agreements (contract management) and administration.
In-depth knowledge of applicable Compliance and Risk standards and management
Exposure to litigation and dispute resolution processes.
Sound analysis, interpretation and application of laws and regulations knowledge
Computer literacy (MS Office packages) and an ability to work with data
A valid certified driver’s licence is essential
Completed articles within the legal environment would be advantageous.
A membership with the Compliance Institute of South Africa or any Legal Institute would be an added advantage.
Experience within a public entity, SETA or government environment will be an added advantage.
Knowledge of South African legislation and regulatory framework.
Understanding and knowledge of regulations and legislation pertaining directly/indirectly to commercial contracts.
Excellent advisory and consultation skills
Knowledge of contract law and principles, Risk and compliance management and corporate governance principles.
Excellent skills in collecting and interpreting data.
Articulate effective communication (written and verbal) skills with the ability to communicate internally and externally (lawyers, regulators, auditors) at all levels.
Good organisational and time management skills would lead to the timely delivery of all outputs

The ability to work under pressure and with minimum supervision.
