    Legislation, Adjudication and Transformation Committee (LATCOM)

    Description

    • Provide oversight over the core regulatory business of CSOS in relation to governance, dispute resolution, and legal services as empowered by the CSOS Act and the Sectional Titles Schemes Management Act (STSMA).
    • Provide strategic guidance and recommendations to the Board on matters relating to:
    • Legislative and regulatory compliance;
    • Adjudication and dispute resolution oversight;
    • Governance and policy oversight;
    • Transformation, and
    • Monitoring the effectiveness of systems, frameworks, and controls relating to the Committee’s mandate.
    • Oversee the development, implementation, and review of the Frameworks, Policies, and Practice Directives on the Regulation of Community Schemes.
    • Oversee the development, review, and implementation of the framework and Practice Directives on the quality assurance and management of schemes' governance documentation.
    • Oversee the development and implementation of a framework for the registration of community schemes.
    • Oversee the development and implementation of guidelines for the promotion of good governance of community schemes.
    • Oversee the development and implementation of the frameworks and policy on Education and Training of Conciliators, Adjudicators, and stakeholders within Community Schemes.
    • Oversee the review of the CSOS Act and the STSMA.

    Requirements

     Essential Requirements:

    • A postgraduate qualification (NQF 9) in Law, Governance, Public Administration, or a related field;
    • An admission as an Attorney or Advocate is mandatory.
    • At least 8–10 years’ experience serving in senior governance, oversight, legal, regulatory, or adjudication environments;
    • 5 to 10 years of management experience gained from Dispute Resolution, Compliance, and Enforcement.
    • A minimum of two (2) years’ experience serving on a governance Committee in a public entity or regulatory environment, responsible for Performance Management, Legal Advisory Services, Alternative Dispute Resolution mechanisms, Education and Training, compliance, and enforcement.
    • Experience in governance oversight, legislative interpretation, adjudication, transformation, or regulatory compliance;
    • Sound knowledge of the Public Finance Management Act (PFMA), Treasury Regulations, governance principles, and public sector regulatory frameworks;
    • Knowledge and understanding of the legislation governing the CSOS will serve as an added advantage.
    • Understanding of Board governance and committee oversight responsibilities;
    • Excellent analytical and communication skills; and
    • High levels of integrity, independence, and ethical leadership.
    • Applicants must not be in the employment of any Government institution.

    REMUNERATION AND TERM OF APPOINTMENT:

    • Compensation will be in accordance with rates as determined in line with National Treasury prescripts. Schedules in this regard are issued annually with specific hourly or daily rates. All other refundable expenses are based on the CSOS’s related policies in line with the National Treasury guidelines. The term of office for the Independent Member shall be aligned with the term of the Board that appointed them, subject to an annual performance review for renewal.
