    Compliance, Enforcement Investigator

    Job Description

    • Issue notices of compliance and non‑compliance to community schemes, as required under the Act, ensuring that all directives are consistent with statutory obligations.
    • Conduct investigations on requests received from adjudicators in terms of S50 and S51 of the CSOS Act and provide investigation reports. 
    • Follow up with non-complying schemes, provide remedial actions to be implemented and reasonable timeframes to ensure compliance. 
    • Verify and validate information received from service providers regarding the verification of schemes project. 
    • Request for final written submissions from parties and upload information on CSOS’ system.
    • Refer non-complying schemes to Legal Services and to Law Enforcement Agencies. 

    Job Requirements

    • Degree or BTech in Law, Compliance, or Investigation.
    • Minimum of Five (5) years’ working experience within a legal compliance environment.
    • Sound understanding of the political and legislative environment of the CSOS Act, as well as the Sectional Titles Management Act, Companies Act, Share Block Act, Schemes for Retired Persons Act, and Cooperative Act.
    • Knowledge of the community schemes environment will be an advantage.
    • Knowledge of compliance and enforcement requirements.
    • Advanced proficiency in Microsoft Office.
    • Excellent communication skills, both verbal and written.
    • Strong project and time management skills.
    • Service-oriented approach.

    Schemes Governance Documentation Officer: GP

    Job Description

    • Receive and review schemes applications for quality assurance of rules (new & existing schemes).
    • Finalise applications for quality assurance of rules (new &existing schemes) post verification.
    • Issuing of compliance certificates for all approved governance rules.
    • Quality assurance of applications for resolutions (special & unanimous) in terms of section 6 (9) of Sectional Tittle Schemes Management Act.
    • Review and quality assure consent applications in terms of section 13 (2) of Sectional Title Schemes Management Act.
    • Attend to governance complaints and queries.
    • Submit complete, reliable and accurate reports.
    • Valid requests for access to schemes governance documents responded to (Section (4) (1) (d).
    • Attend to any matters incidental to the role that support the CSOS governance mandate.

    Job Requirements

    • LLB or 3–year degree in Law (NQF 7).
    • Minimum of 3 - 4 years working experience in a related legal or governance role.
    • Postgraduate qualification in Law and Admission as an Attorney will be an added advantage.
    • Previous experience working with community schemes will be an added advantage.
    • Proficient in MS Office applications (Word, Excel, PowerPoint).
    • Knowledge:
    • Comprehensive knowledge of the Community Schemes Ombud Service (CSOS) Act & Regulations
    • In-depth understanding of the Sectional Tittles Schemes Management Act 08 of 2011 & its regulations
    • An Understanding of the Companies Act Sectional Tittles Act 95 of 1986; promotion of Administrative Justice Act 03 of 2000 and the Constitution of the Republic of South Africa

    Legislation, Adjudication and Transformation Committee (LATCOM)

    Job Description

    • Provide oversight over the core regulatory business of CSOS in relation to governance, dispute resolution and legal services as empowered by the CSOS Act and the Sectional Titles Schemes Management Act (STSMA).
    • Oversee the development, implementation and review of the Frameworks, Policies and Practice Directives on the Regulation of Community Schemes.
    • Providing oversight on the implementation of dispute resolution services in CSOS, including the development and implementation of Practice Directives on Dispute Resolution.
    • Oversee the development, review, implementation of framework and Practice Directives on the quality assurance and management of schemes governance documentation.
    • Oversee the development and implementation of a framework for the registration of community schemes.
    • Oversee the development and implementation of guidelines for the promotion of good governance of community schemes.
    • Oversee the development and implementation of the frameworks and policy on Education and Training of Conciliators, Adjudicators, and stakeholders within Community Schemes.
    • Oversee the review of the CSOS Act and the STSMA.

    Job Requirements

    • A relevant degree or equivalent qualification in Property Law, Dispute Resolutions and Compliance and Enforcement
    • An admission as an Attorney or Advocate is mandatory.
    • 5 to 10 years management experience gained from Property Law, Dispute Resolution and Compliance and Enforcement.
    • A minimum of two (2) years’ experience serving on a committee responsible for Community Schemes Governance, Performance Management, Legal Advisory Services, Alternative Dispute Resolution mechanisms, Education and Training, Compliance and Enforcement.
    • Knowledge and understanding of the Public Finance Management Act and its Treasury Regulations, and legislation governing CSOS will serve as an added advantage.
    • Knowledge and experience in legal compliance and alternative dispute resolution.
    • Excellent communication skills (verbal and written).
    • Applicants must not be in the employment of any Government institution.

    Senior Accountant Budget, Planning and Reporting

    Job Description

    • Support the budget planning process
    • Draft CSOS’s budget in a format prescribed by National Treasury and divide into a capital and an operating budget
    • In drafting the budget, reflect of realistically, anticipated revenues by major revenue sources for the year concerned
    • Support the financial reporting process
    • Develop policies, processes and procedures and provide specialist inputs.
    • In preparing financial reports, comply with relevant templates, in line with the legislative frameworks
    • Review the general ledger (Maintain accounting systems for the organisation)
    • Prepare and submit monthly and quarterly financial management reports
    • Prepare annual financial statements
    • Prepare ENE report
    • Prepare quarterly reports on National Treasury template
    • Prepare annual financial statements on National Treasury template
    • Provide input and assist in the preparation of the organisation’s annual report
