    Senoir Legal Counsel

    Job Description

    • Reporting to the Principal Legal Counsel in the Legal Services Division, the Senior Legal Counsel provides expert legal advice, leadership and strategic direction on the interpretation and application of competition law across all Commission Divisions. The role involves addressing anti-competitive conduct, preparing, and presenting cases before the Competition Tribunal and Competition Appeal Court with legal integrity.     Key Accountabilities 

    The main responsibilities of the incumbent will, inter alia, include:

    • To contribute to the strategic planning of the Legal Services Division and the Competition Commission.
    • To assist the Principal Legal Counsel with the management and supervision of section members.
    • To assist in and contribute to the effective administration of the Legal Services Division.
    • To provide timely, well researched legal advice and opinions to facilitate informed and sound decision making by case teams, the Competition Commission and EXCO within specified deadlines.
    • To effectively manage, coordinate and present cases before, inter alia, the Competition Tribunal, Competition Appeal Court and High Court.
    • To instruct, brief and manage attorneys and counsel representing the Commission.
    • To assist in the negotiation and conclusion of consent and settlement agreements.
    • To contribute to knowledge sharing by, inter alia, participating in the training and capacity building initiatives of the Legal Services Division and the Commission.

    Job Requirements
    Skills and Experience

    We are looking for a dynamic, hardworking and a committed individual who meets the following requirements:

    • A Bachelor of Laws (LLB) degree or equivalent legal qualification.
    • Admission as an attorney or advocate is strongly recommended.
    • 6-8 years litigation experience, preferably in civil and commercial law or competition law experience is an advantage.
    • Research, analysis, drafting and litigation skills.
    • Case management, oral and written communication skills, negotiation and interpersonal skills as well as computer literacy.

    Economist

    Job Description

    • The Competition Commission seeks to recruit dynamic, hard-working and committed individuals to fill the role of Economist in the Economic Research Bureau Division. Applicants should be organised, thorough and enjoy challenging situations. Attention to detail, ensuring quality and standards are met and keeping errors to a minimum are important factors in this position. Researching and gathering facts are an important part of the job.?The successful individuals will participate in economic research in line with the Commission’s mandate to address anti-competitive conduct and evaluate mergers.
    • A starting annual total Cost to Company package of R 1?092?619,93 (negotiable commensurate with experience) 
    • Please note this position is available on a five-year fixed term contract, renewable. 

    Key Accountabilities 

    The main responsibilities of the incumbent will, amongst others, include to: 

    • Assist with the gathering of evidence and rigorous economic analysis of competition cases under investigation along with the drafting of investigation reports within the cartels, market conduct and mergers divisions. 
    • Assist with the drafting of expert economic reports filed with the Competition Tribunal on competition cases in litigation. 
    • Assistance to the expert economist and legal teams for cases in litigation before the Competition Tribunal, including rebuttal evidence and cross-examination of witnesses. 
    • Contribute to and lead economic research in support of the Commission’s strategy including research on specific sectors or competition issues, scoping of market inquiries, monitoring economic concentration, identification of barriers to entry and expansion, identifying the underlying causes of the high cost of living and key developments in other jurisdictions.  
    • Contribute to and lead research into the proactive initiation of competition complaints   
    • Contribute to and lead research into regional, continental and international cross-border competition issues 
    • Contribute to the provision of the theoretical and intellectual platform for the effective implementation of the Competition Act, including the drafting of guidelines. 
    • Assist in preparing an address to various Industry forums with respect to the economic implications of decisions taken on specific cases, participating in the meetings as appropriate. 

    Job Requirements
    We are looking for a dynamic, hardworking and a committed individual who meets the following requirements: 

    • Applicants MUST have a Masters degree in Economics. 
    • Training and experience in Microeconomics, Econometrics, Industrial Organization and/or International Trade is considered to be advantageous. 
    • Strong analytical skills are essential. 
    • Minimum of 4 – 6 years work experience in a rigorous economic analysis environment. 
    • Knowledge and understanding of the purpose and objectives of the Competition Act, the Competition Commission and the South African economy is highly recommended.

    Junior Financial Analyst (ERB)

    Job Description

    • We are looking for a dynamic, hard-working and committed individual to conduct financial analysis, financial research and thought leadership in competition policy development; ensuring the application of sound financial principles in all work performed.
    • (A starting annual total cost to company package of R 938 471.62 negotiable commensurate with experience)

    The main responsibilities of the incumbent will, inter alia, include:

    • Assist with the identification of issues to be assessed in an investigation and the evidence required to analyse those issues.
    • Assist with the development of information requests and survey instruments to gather the required evidence, including follow up requests.  
    • Assist with research to aid the team’s understanding of the market dynamics and business models in a given market.
    • Analyse financial data for competition investigations, focusing on market conduct, mergers, and potential anti-competitive practices
    • Provide assistance into the compilation of expert reports to inform The Tribunal, based on a review of the facts of the case and additional information gathered to support an economically defensible recommendation.
    • Report to the Principal Analyst or Senior Analyst on the progress and outcomes of research and investigations, including the economic underpinnings of competition issues.
    • Contribute to the provision of the theoretical and intellectual platform for the effective implementation of the Competition Act.

    Job Requirements
    We are looking for a dynamic, hardworking and a committed individual who meets the following requirements:

    • Honours Degree or equivalent in Finance, Accounting or Management Accounting.
    • Masters or Membership of a recognised professional body (SAICA, CFA, CIMA or ACCA) added advantage.
    • A minimum of 2 - 3 years related work experience. Additionally, working experience in competition economics will be an advantage.
    • Specific experience in cost accounting/management or regulatory financial analysis will be an added advantage
    • Strong analytical skills and experience in managing research are essential.
