An appropriate three-year career-related tertiary qualification (degree) in Labour Relations, Law or any other study field related to the position
A postgraduate qualification in Labour Law or Law will be added advantage
At least six years’ relevant working experience in a labour relations environment
Thorough knowledge of the Labour Relations Act, 1995 (Act 66 of 1995), Basic Conditions of Employment Act, 1997 (Act 75 of 1997), Employment Equity Act, 1998 (Act 55 of 1998) and Skills Development Act, 1998 (Act 97 of 1998), Commission for Conciliation, Mediation and Arbitration, bargaining councils, Labour Court and other forums
A valid Code B driving licence
Computer literacy
Must undergo a criminal record check and such a person shall allow their fingerprints to be taken by the Tshwane Metro Police Department at own cost
Primary functions
Provide legal advice to client departments and any other departments on request to ensure compliance with organisational policies and collective agreements in line with legislative prescripts
Represent the City of Tshwane at conciliation, arbitration and litigation of disputes at the South African Local Government Bargaining Council (SALGBC), the Council for Conciliation, Mediation and Arbitration (CCMA) and other related forums
Facilitate labour court matters and conduct legal research
Attend to cases referred or allocated for advice, consultation, conciliation and arbitration
Gather evidence and seek mandates from client department heads or managers with the utmost care and diligence
Conduct case management by engaging potential witnesses and strategising on the best and correct approach in representing the City of Tshwane at hearings
Perform risk and crisis management duties by advising clients on how to handle complex labour or employee situations
Perform case management administration on case records
Ensure strict compliance with time frames in respect of all labour matters
Remain abreast of trends, organisational awareness, organisational policies, collective agreements, reviews, directives and legislative amendments including court decisions in relation to the diligent execution of duties
Provide regular updates and feedback report on cases to client departments and managerial line (immediate supervisors) for allocated cases
Communicate effectively with the SALGBC, CCMA and other related dispute forums
Render legal labour assistance, including labour education on issues such as employment organisational policies, disputes and contracts
Advise on minimal liability and legal exposure for the City of Tshwane, research the implications of legislation and case law that could impact the business and report findings back to the head of legal services
Receive information and notices from the SALGBC, CCMA and other forums on all cases and ensure that cases are handled as per the directives and/or rules of the applicable forum
Render correct and proper comments on reports to client departments
