    Legal Risk And Compliance Man

    Role Purpose    
    This role is positioned in the Momentum Health Lesotho business and accountable for risk management, legal and compliance risk management.   The Risk Manager will:

    • Provide the overall direction for risk management, legal (including Secretariat) and Compliance.
    • Manage Anti- Money Laundering (AML) and Counter Financing of Terrorism & Proliferation (CFT&P) activities within the Lesotho legal framework
    • Provide a trusted forward-looking view of risk that advances strategy and achievement of balance between risk and reward, while challenging business to manage risks better, thereby enhancing the business’s reputation with all stakeholders.
    • Implement a set of risk metrics and reports, including losses and incidents, key risk exposures, and early warning indicators.
    • Improve the Health business’s risk management readiness through communication and training programs, performance measurement and incentives, and other change management programs.

    Requirements    

    • Postgraduate qualification in Corporate Governance, Risk Management and/or Compliance is an added advantage.
    • Bachelor’s Degree in Law.
    • Registered with Institute of Chartered Secretaries (preferred).
    • Admitted legal practitioner (added advantage).
    • Minimum 4-8 years’ experience in business, finance, audit, risk management, legal or compliance within health insurance or financial services industry.
    • 3 years’ experience in a company secretary role management level.
    • Experience dealing with various regulators.
    • Sound Knowledge and understanding of corporate law and corporate governance.
    • A great team-player and capable of working in a team.
    • In-depth understanding of the regulatory compliance requirements for both the health industry and financial services specific regulatory requirements.

    Duties & Responsibilities    
    INTERNAL PROCESS

    • Reporting to Executive management, Combined Assurance Forum and Board informing them about the current risk profile and emerging threats.

    The reporting headings might include:

    • New events
    • Follow up on past events.
    • Emerging risks
    • Results of risk, compliance, legal and audit reviews
    • Progress towards risk improvement objectives
    • Maintain independence of the risk management function, the role of the Risk Manager shall not have any business or revenue generation responsibilities. This is a standard regulatory expectation and requirement.
    • Understand and influence business strategy and culture through collaboration within the Health business.
    • Keep abreast of legislation and best practices within the risk, market conduct, legal and compliance field and pro-actively identify how this will influence business and risk strategy.
    • Provide stakeholders with insights regarding risk drivers to increase management’s responsiveness and influence business decisions.
    • Foster a risk aware culture where risk and compliance activities are integrated and embedded in business practises through ongoing communication and education.
    • Establish the risk management process for the Business Unit including identification, assessment, monitoring, management and reporting on key risks facing the business.
    • Manage the identification and investigation of material risks that may have an impact on the ability of the business to meet its objectives, in conjunction with the risk community.
    • Direct and oversee the implementation of the risk management , legal and compliance framework and solutions within the business, ensuring that the business stays within its risk appetite.
    • Establish the legal and company secretarial management process for the country including identification, assessment, monitoring, and management and reporting on key risks facing the business.
    • Direct and oversee the implementation of legal and company secretarial framework and solutions within the country, ensuring that the country remains adherent to the statutory and legislative requirements.
    • Manage the ongoing assessment of the adequacy and efficiency of risk ,legal and compliance management framework, risk appetite statement, risk management strategy and controls at a Business Unit level and drive the implementation of measures to enhance controls and risk management.
    • Develop risk legal and compliance governance structures within the Business Unit to facilitate the appropriate, accurate and timely flow of information.
    • Contribute to corporate governance structures, policies, and frameworks to ensure continuous integration, collaboration, and alignment of legal and compliance practices across the company.
    • Develop strong partnerships across the business that facilitates the managing and mitigation of risks across the various areas of the business, resulting in an integrated risk management effort.
    • Provide executive management within the country with advice on the risk , legal and compliance implications of business activities, and provide consultative support to assess, prioritise and mitigate potential risks.
    • Oversee the implementation of strategic risks-related projects and risk transformation agendas, including process and system developments.
    • Prepare quarterly risk management reports for MHS Exco, Combined Assurance Forum and the Board of Directors.
    • Drive the implementation of the Integrated Assurance framework within the business unit with management, internal audit, and external audit.
    • Ensure compliance with NBFIRA regulations, anti-money laundering (AML) laws, and all other industry practices.
    • Designs and implements compliance programs aligned with regulatory and internal policy requirements.
    • Conducts training and awareness programs.
    • Investigates breaches and ensures corrective actions.

    CLIENT SERVICES

    • Build and maintain relationships with clients and stakeholders, including appropriate regulators.
    • Contribute to sustaining a competitive edge through external networking, benchmarking and representation on related forums.
    • Contribute to defining (with the segments) fair and innovative client service practices which build rewarding relationships and allow team to provide exceptional client service.
    • Engage with key internal and external stakeholders to identify changing client needs and make recommendations to align service offering with client needs.
    • Contribute to a client service excellence culture which builds enduring relationships and allows team to provide exceptional client service.
    • Assist the business to develop client service level agreements and standards to ensure clients receive clear and accurate information and are kept always informed.
    • Assist the business to drive efforts to improve client service and fair treatment of clients within area of responsibility.
    • Incorporate client feedback into the enhancement of daily business processes and management operating systems.
    • Participate and contribute to a culture which builds rewarding relationships, facilitates feedback, and provides exceptional client service
