    Director: Fiscal, IA & PRLS

    Purpose of the Role

    • To draft and scrutinise fiscal and intergovernmental legislation and support its legislative processes, to comment on draft legislation impacting on fiscal and intergovernmental legislation and to advise on interpretation of fiscal, intergovernmental, accounting and procurement related legislation.

    Full title of the position is Director: Fiscal, Intergovernmental, Accounting and Procurement Related Legislative Services

    Qualification/s Requirements

    • A Grade 12 is required coupled with a minimum LLB Degree (equivalent to NQF level 8); 
    • LLM (equivalent to NQF level 9) degree and certificate/s on legislative drafting courses will be an added advantage; 
    • A minimum 5 years’ experience at a middle managerial level (Deputy Director) obtained in a legal environment; 
    • Knowledge and experience in legislative drafting, constitutional and administrative law; and statutory interpretation; 
    • Knowledge of fiscal and intergovernmental legislation and budget processes; 
    • Experience in the Executive’s and Parliament’s processes for considering draft legislation; and 
    • Successful completion of the Nyukela Public Service Senior Management Leadership Programme as endorsed by the National School of Government available as an online course on https://www.thensg.gov.za/training-course/sms-pre-entry-programme/, prior to finalisation of an appointment.

    Key Performance Areas

    Drafting and Processing of Fiscal, Intergovernmental, Accounting and Procurement Related Legislation: 

    • Provide guidance on legislative processes and participate in policy processes that may require legislation;
    • Draft Bills, Scrutinise draft Bills prepared by line units or entities of National Treasury; 
    • Assist internal stakeholders with legal aspects of socio-economic impact assessments of draft Bills;
    • Prepare documentation for the processing of draft Bills, namely to the Minister, Directors-General Clusters, Cabinet and Parliament, and support the processing of draft Bills; and 
    • Prepare legal instruments required for the commencement of Acts. 

    Comment on Draft Bills relating to Fiscal, Intergovernmental, Accounting & Procurement Related Legislation: 

    • Provide inputs on draft Bills initiated by other national departments submitted to the National Treasury before the Directors-General Clusters and Cabinet processes; 
    • Provide input on draft Bills submitted to Directors-General Clusters and Cabinet, by identifying provisions that may impact on the National Treasury or legislation administered by the Minister of Finance; and 
    • Provide inputs on Bills in Parliament, introduced by other Ministers or Members of Parliament; 

    Drafting and Scrutiny of Subordinate Fiscal, Intergovernmental, Accounting and Procurement Related Legislation: 

    • Draft regulations and other legal instruments to be made by the Minister of Finance with supporting documentation required for the promulgation of the legal instruments; 
    • Scrutinise draft regulations and other legal instruments, prepared by line units or entities of National Treasury, to be made by the Minister of Finance with supporting documentation required for the promulgation of the legal instruments; and 
    • Provide or co-ordinate inputs on draft regulations and other legal instruments initiated by other national departments submitted to the National Treasury before promulgation. 

    Review of Fiscal, Intergovernmental, Accounting and Procurement Related Legislation: 

    • Audit legislation for technical alignment and adherence to best practice and other primary legislation of the National Treasury; and 
    • Assess legislative requirements against government’s policy objectives and initiate reviews of legislation. 

    Interpretation of Fiscal, Intergovernmental, Accounting & Procurement Related Legislation: 

    • Advise internal stakeholders on the interpretation of legislation.
