Legal Officer - Cape Town at TB HIV Care

Purpose of the position:

• To add value and improve our overall operation through contractual management and administration. The successful candidate will possess thorough knowledge of the statutory laws of South Africa and sound judgement

Minimum Requirements    

• A relevant qualification from a three-year college or university; and one to two years related experience and/or training; or an equivalent combination of education and experience.
• At least 1 - 2 years, relevant experience at a minimum, or completed accredited paralegal course
• 3 - 4 years relevant experience at a minimum Funder rules and regulations including PEPFAR and Global Fund NGO experience (advantageous) POPIA knowledge (advantageous)
• Valid drivers licence
• Clear criminal record

Duties and Responsibilities    

• Perform annual risk assessment linked to various awards through contract reviews
• Develop a risk register based on reviews
• Communicate risks to relevant stakeholders and monitor resolution
• Oversee administration of manual and electronic copies of all legal documents
• Ensure accuracy and completeness of contract registers
• Proactively communicate with relevant stakeholders prior to legal documents expiring
• Working with the grants team to ensure legal compliance and manage risks
• Advising on best practices and standards
• Conduct detailed legal reviews of the organisation’s progress against contracted requirements and financial documents
• Ensure compliance with funder requirements. Ensure compliance with statutory and legal requirements, including POPIA.
• Developing and facilitating compliance with relevant public and private laws and regulations, including through staff training programmes. Implementing a system to track, expedite, and fulfil legal support requests, which may range from urgent support on contracts, employment law questions, and registration of new entities
• Draft and review all forms of contracts including HR, operational, MOUs, and funder contracts
• Prepare and present reports as required
• Report on the results of internal legal investigations to the manager
• Provide legal advice to internal stakeholders
• Build and maintain relationships with internal and external stakeholders
