    Senior Manager: Compliance

    Mission/ Core purpose of the Job

    The Senior Manager: Compliance is responsible for managing the Group Finco Compliance team to ensure employees and the company comply with all industry guidelines, regulatory requirements, and ethical standards. The role is responsible to manage the development and implementation of the Group Finco Compliance strategy. The role will ensure alignment to the guidelines and frameworks provided by MTN Group Risk & Compliance teams with regard to  controls and risk and compliance process, templates, metrics, risk registers etc.

    This role is responsible to oversee and manage the following:

    • Defining controls standards for all processes
    • Ensuring adherence across all Opcos
    • Providing regulatory assistance to Opcos when necessary
    • Monitoring Opcos overall performance and alignment with the Group Finco Compliance strategy
    • Supporting Opcos with the implementation of compliance mechanisms
    • Identifying ethics risks and any potential issues with current procedures, and overseeing the development of relevant mitigation interventions
    • Reporting to Group Finco Exco on areas of non-compliance, on the outcomes of internal controls assessments and on an ad-hoc basis on specific management requirements

    This role is required to stay up to date on all relevant compliance and regulatory requirements and to lead changes to the Group Finco regulatory framework and compliance policy.

    Key Performance Areas: Core, essential responsibilities / outputs of the position (KPA's) (1/3)

    Strategy Development and Implementation

    • Provide inputs to the creation of the Group Finco Compliance strategy in line with the overarching business goals
    • Ensure effective implementation of the Group Finco Compliance strategy by means of providing direction, structure, frameworks, models, plans and roadmaps
    • Cascade and communicate overall Compliance Strategy and Business Plan
    • Translate the Compliance strategy into operational initiatives and plans and drive execution
    • Define detailed Compliance plans for various fintech products and services

    Operational Delivery

    • Ensure alignment & where applicable adherence to directives guidelines & frameworks issued by MTN Group Risk & Compliance
    • Lead the changes in the Group Finco regulatory framework and compliance policy (e.g., regulation changes, new services, license, etc.), including Data Privacy compliance requirements
    • Monitor Finco’s Compliance agenda and directives and assist Opcos’ first line management to implement the necessary compliance mechanisms
    • Identify ethics risks and oversee the development of risk mitigating interventions
    • Identify potential issues with current procedures that may impact risk, audit, regulatory and legal requirements
    • Oversee the design and implementation of internal controls assessments and quality measures
    • Develop and ensure execution of compliance monitoring and testing methodologies, techniques, and procedures
    • Develop training programs to ensure the Group Finco compliance team is adequately trained on legislative requirements and appropriate compliance methodologies
    • Maintain continuous oversight of collection and dissemination of any regulatory, Compliance Monitoring and Testing and audit issues to provide ongoing advice and guidance to the General Manager and stakeholders
    • Monitor the financial performance of the Compliance unit versus budgets and ensure all activities are carried out in line with the approved guidelines while promptly reporting on any variances to the General Manager: Compliance and Fin Crime
    • Understand the impact of potential changes driven by the regional / local regulators, industry, marketplace, and/or legal environment and report these back to leadership

    Operational Delivery  (Continued)

    • Review and report on the quality of OpCo Compliance Monitoring and Testing programs and assist in improving their maturity
    • Review all contracts to ensure protection of Group Finco’s interests
    • Oversee the design and effectiveness of Group Finco’s detection, monitoring, and reporting operations programme for financial crimes related to money laundering and terrorist funding
    • Stay up to date on all relevant compliance and regulatory requirements within the Telecommunications and FinTech industry

    Governance

    • Operational, Tactical and Strategic Meetings
    • Participate in strategic meetings, ensure relevant participation, and provide guidance and input in the various discussions. Solicit feedback and input from opco Finco
    • Drive adequate risk mitigation and controls and elicit inputs from relevant parties
    • Request relevant budget for internal projects
    • Prepare proposal on change initiatives, policies, and procedures

    Escalations

    • Escalate issues that will result in severe time, scope, productivity, and cost or resource impact
    • Manage and provide solutions to escalations that have multiple processes / functions impact on critical path of service delivery

    Tactical

    • Review and finalise objectives, targets, and budgets for the Compliance function as applicable
    • Review key risks, issues and dependencies and set mitigation actions
    • Develop and manage budgets
    • Facilitate and or Sign-off / make decisions regarding tactical changes

    Performance

    • Monitor performance and alignment with Group Finco Compliance strategy
    • Ensure alignment between other functions within Finco teams

    Reporting

    • Report monthly to the GM on areas of non-compliance to applicable legislation and PPPs
    • Report periodically on the outcomes of internal controls assessment
    • Report on an ad-hoc basis on specific management requirements as and when necessary

    Budgets

    • Manage functional budgets in line with overall budget and business objectives
    • Managing project initiative budgets in line with business objectives
    • Support the reduction of cost of operations, in line with a least cost operating strategy stemming from the business drivers

    Staff Leadership and Management

    • Continually develop a culture of strong collaboration and effective team working
    • Provide guidance and leadership ensuring future focus and current efficiency
    • Coach and mentor direct reports to ensure staff motivation is high
    • Ensure adequate succession planning & that succession plans are achieved
    • Set KPIs and provide regular performance feedback through a well-defined and implemented performance review program
    • Ensure the effective management of diversity among personnel in the division
    • Identify staff training and development needs and implement necessary actions
    • Manage team (including recruitment, on boarding, attrition)
    • Recruit and build a world class Compliance team
    • Set goals and objectives for direct reports, monitor progress, and maintain motivation
    • Set up appropriate structure to meet departmental management objectives

    Job Requirements (Education, Experience and Competencies) (1/3)

    Education:

    • Minimum of 4-year tertiary degree in Business Administration, Financial Management, Internal Auditing, Accounting, Bachelors of Science or related field
    • MBA or Masters (advantageous)
    • Professional Certifications e.g. Compliance Management, Risk Management etc. would be an advantage
    • Risk Management Certifications (CISM, CISA, PMI-RMP, CRMP etc) is advantageous

    Experience:

    • Manager track record of 4 years or more; with at least 3 years’ experience in Compliance Management, Risk Management, Internal Audit in Fintech/Financial Services
    • Minimum of 7 years of experience in managing regulatory and compliance requirements within the Fintech, Financial Services, Insurance, Banking industry
    • Hands on experience in managing, leading and implementing compliance policies, procedures, and initiatives
    • Experience in ecommerce and electronic payment business is advantageous
    • Entrepreneurial spirit, self-driven and ability to motivate a fast-paced team
    • Worked across diverse cultures and geographies
    • Pan Africa multi-cultural experience is advantageous
    • English speaker. French, Portuguese, Zulu, Swahili, and other African languages a plus
