Job Description

• As a trainer you will be required to develop, facilitate, and deliver training programs that enhance the skills, knowledge, and safety compliance of employees and operators in line with Fermel's standards, customer expectations, and legislative requirements. The Trainer plays a key role in ensuring the competency of personnel working with underground mining equipment and associated systems.

Training Delivery & Facilitation

• Deliver classroom and on-site training sessions in accordance with training plans and schedules.
• Provide practical operator training on Fermel’s trackless mining machines and equipment.
• Conduct assessments and observations to ensure competency and safe operation.

Training Development & Compliance

• Align training content with OEM specifications, health & safety regulations.
• Update training documentation and maintain accurate training records.

Competency Assessments

• Conduct initial, refresher, and remedial training assessments.
• Identify skills gaps and recommend targeted interventions.

Stakeholder Engagement

• Liaise with supervisors, safety officers, and technical managers to align training with operational needs.
• Provide training support for external clients and field service technicians.
• Support skills development programs, apprenticeships, and learnerships.

Compliance and Safety

• Ensure training aligns with the Mine Health and Safety Act (MHSA), OHS Act, and other relevant legislation.
• Promote a culture of safety, quality, and continuous improvement.

Minimum Requirements:

Qualifications:

• Grade 12 (Matric) essential.
• Occupationally Directed Education Training and Development Practitioner (ODETDP) Certificate or equivalent.
• ETDP/Assessor/Moderator certification
• Valid Driver’s Licence (Code 08 or higher).

Experience:

• Minimum 3–5 years’ experience in training and development, preferably in the mining or engineering sector.
• Previous experience training operators on underground mining equipment (advantageous).
• Familiarity with MQA / QCTO processes and standards.

Technical Skills:

• Sound knowledge of underground trackless mining machines and hydraulics/electrical systems.
• Computer literacy (MS Office Suite, LMS platforms).
• Strong facilitation and presentation skills.

Job Purpose

• The Compliance Manager and Legal Counsel is responsible for ensuring that the company operates in full compliance with all legal, regulatory, and ethical standards applicable in South Africa. This dual role involves providing legal guidance to support strategic and operational decision-making, managing legal risks,  and overseeing the compliance management system.

Key Responsibilities

Compliance Management

• Implement, and maintain the company’s compliance framework in accordance with local and international regulatory requirements (e.g., FICA, POPIA, Companies Act, Competition Act, etc.).
• Monitor and interpret new and emerging legislation and regulatory changes, together with Fermel’s compliance consultants and assess the impact on the business.
• Conduct regular compliance audits, risk assessments, and internal reviews to ensure adherence to laws and policies.
• Prepare and deliver compliance training to staff across departments, together with Fermel’s compliance consultants.
• Act as the primary point of contact between Fermel and Fermel’s compliance consultants.
• Investigate and resolve compliance breaches.

Legal Counsel

• Provide legal advice and support to internal stakeholders on a wide range of matters including corporate law, commercial contracts, employment law, litigation, data protection, and IP.
• Draft, review, and negotiate commercial agreements including NDAs, supplier/customer contracts, MOUs, and service level agreements.
• Manage and coordinate external legal service providers when necessary.
• Support corporate governance activities, including Board and Committee processes, resolutions, and company secretarial duties.
• Assist in dispute resolution, litigation management, and regulatory investigations.
• Support mergers, acquisitions, and other strategic transactions from a legal perspective.

Qualifications & Experience

• Bachelor of Laws (LLB) required; Admitted Attorney of the High Court of South Africa.
• Postgraduate qualification in Compliance Management or equivalent (advantageous).
• Minimum 5–8 years’ experience in a legal and/or compliance role, preferably in a regulated industry (e.g., financial services, manufacturing, healthcare, mining, or telecommunications).
• Proven track record in designing and managing compliance programs.
